Working Time Breaks and 15 hour days

tachograph:

ROG:
It says DAY - how many working hours in the DAY?

It says “Working Time Breaks and 15 hour days”.

A 45 minute break at 5 hours 59 minutes will not legally “count as your full wtd break for the day” (comprising a 15 hour shift) unless there’s at-least 2 hours and 16 minute of POA/break in the shift and after the 45 minute break.

As the OP never mentioned or asked about POA, or breaks shorter than 15 minutes, it seems to me to be reasonable to assume that he will need to have completed another break of at-least 15 minutes sometime before exceeding another 6 hours working time.

Therefore the answer to the OPs question is, No a 45 minute break at 5 hours 59 minutes will not “count as your full wtd break for the day”, you will need another 15 minute break before exceeding another 6 hours working time.

Very true but without extra info …

Nick - it states that a worker must not work more than 6 hours without a break and a break must be at least 15 mins

What you have stated it the TOTAL amount of break required for the work done in a shift

13 hour shift
work 2/drive 4 = 6 hours
45 min break
work 1/drive 2 = 3 hours
POA 15 mins
work 1/drive 2 = 3 hours
END

LEGAL for tacho and RTD

Not legel unless the last was 2 hours and 59 minutes

WHY ?

Ok Rog

In you example above the two 3 hours drive and work add up to 6 hours so if you have worked for 6 hours you would need an a break of 15 minutes the POA is not a break

ROG:
VOSA guide missed out the 6 hour rule !!!

Breaks:
— Mobile workers must not work more than 6 consecutive hours without taking a break.— If your working hours total between 6 and 9 hours, working time should be interrupted by a break or breaks totalling at least 30 minutes.
— If your working hours total more than 9 hours, working time should be interrupted by a break or breaks totalling at least 45 minutes.
— Breaks should be of at least 15 minutes’ duration.

do you mean the bit in red is not in the guide, well i got it from it on page 46

ok missed that, but 1 hour work and 2 hours drive = 3 hours work x 2 = 6 hours work, if you work 6 hours without a break you need to take a break of 15 minutes before the end of your shift. so based on you example, I said it would be legal if the last on was 2 hours and 59 minutes and the go home no 1 hour work and 2 hours drive you can not take a RTD break at the end of your shift

Where does the 2 hrs 59 mins come from?

The rule is - no worker shall work MORE than 6 hours without a break of at least 15 mins

3+3=6 which is not more than 6

so if that’s the case then 4 hours 30 minute drive IE 4:30:00 would not required a break until you did 4:30:01 the EU wrote the both regs

drivers hours

Breaks
After a driving period of no more than 4.5 hours, a driver must immediately take a break of at least 45 minutes unless he takes a rest period. A break taken in this way must not be interrupted.
