Just exactly how do you think as a professional driver you can even begin to justify driving a truck with your phone to your ear with all the publicity that this “crime” has received in recent years is beyond me.
Just what would you advocate for a serious driving offence? Ban for life maybe?
Its a mobile phone offence, no puppies run over or kittens squashed in the process.
As for having to answer to the TC, its ridiculous. The guys already been punished with points and fine, what other country punishes someone twice for the same offence
The USA, where it is perfectly legal to be tried thrice for certain offenses if you are a serving member of the military and twice if you are civilian.

Ignoring the barrack room lawyers, the guy who quotes the Senior TC’s guidance is correct. That’s what the guidance says. However, it was issued by the former Senior TC, and TCs may deviate from what is laid down if they see a good reason to. It also comes down to which TC it concerns… if you did it in the North West then it’s probably good news for you that Beverley Bell is no longer in post.
The new TC has issued revised statutory documents, that part doesn’t appear to have been revised.
But you are correct, each TC can use their initiative.
I always prefer to give the worst case scenario - that way there can only be pleasant surprises.

I got tugged a while ago for picking up my phone whilst driving, after speaking/grovelling to the copper i asked if I’d be reported to the tc, he told me it was at his discretion and after a 5 minute chat and lecture he said he’d recommend me for a drive safe course rather than points and fine, and this time he wouldn’t report me…
Lesson learn’t, I now own a plantronics voyager legend Bluetooth device, awesome bit of kit and hoghly recommended for full time drivers [emoji106]

Actually it is your boss. As a O-Licence holder or a named person on an O-Licence you agree to an undertaking to inform the OoTC of any prosecution or FPN which might affect someone’s suitability or fitness to hold a vocational licence.

Right, firstly I don’t use a mobile when driving on non hands free, as I’ve no desire to get points and a fine.
On the other hand playing Devil’s Advocate for a minute, and ignoring the stats (any stats can be massaged to prove any point desired) and ignoring the propaganda used to ram the point home…
So question is…Is using a mobile when driving any more dangerous than…

We’ve all done these on the Mway and passed an MSA or something without remembering it…aka Autopilot.
Thing is the older ones among us ALL (including the self righteous) used mobiles or as they were then fixed car/truck phones, (got my first in 1983) when driving when they first came out, …that is what they were primarily designed for.
We continued to use them up to about 15 or so years ago, and thought nothing about it…then the next day it was deemed dangerous and illegal, in other words on Monday it was safe, Tuesday it was dangerous.
When txting came on the scene that took things to another level in terms of dangerous acts whilst driving, so they banned everything to do with phones.
Do you get my point, or have I explained it badly?
So the o/p…this guy was caught, he will get done…and quite rightly so, no arguments.
Whether he should try and wriggle out of it is up to him and his conscience, and ■■■■ all to do with anyone else.
He’s came on here admitting he’s done wrong (brave stupid or both) he knows he’s made a ■■■■ of himself, he accepts he’s getting nicked,…so why tf give the guy a hard time.
Let he who cast the first stone etc etc,

Btw- my very first phone was one of those transportables, the one with the 12v car battery attached. Imagine the laughs carrying that about today…

Seriously, a bad error of judgement? You are fully aware it’s illegal. And got what you deserved, personally, and no dog at you but all truck drivers and car drivers on the phone should get an instant 3 month driving ban.

I’m sure I read somewhere that a guy got done in a car pulled over, stopped safely on roadside with his engine running. This is the good old UK mate, any opportunity to make a quick buck and smugly justify it under the Road Safety agenda, have you never heard of ‘‘Safety’’ cameras for example.
Is it dangerous? Everyone on here must see everyday how easy it is to spot a driver on the phone. Not from seeing the phone but the tell tale lane wandering and the speed control going out the window, usually slowing too much.

That’s true. The guy on the phone could call the ambulance straight away.
Breaking the Law,as many of us have and still do more by habit than intentional,but with all the adverse publicity about phone use by LGV Drivers in particular, Drivers should be more aware of what they are doing and think about changing that habit.
Its the same habit as releasing your seat belt in preparation a few yards before you actually stop because your only moving a few yards at a slow speed,your still breaking the law.

I think people like the OP, are at best naive when they post such online. Firstly: The audience cannot be vetted… none of us will necessarily know what each other’s experiences might be. What for some is trivia, to others might just be a hurtful reminder of something deeply painful.
