As a professional driver you should know better, attempting to justify it because you weren’t going very fast (so you say), on a quiet road (so you say) somehow in your tiny, twisted mind makes it not so serious?
Tell that to the families who have lost relatives at the hand of people who had the phone to their ear whilst driving, if it were down to me I would ban you for life!

It obviously wasn’t that dangerous. If it was, the police would have stopped him there and then to prevent the carnage, NOT send him a demand for cash when he’s finished.

Hopefully the OP will learn from this incident, and not do it again.

My only view on the subject is that IF they ever use a mobile phone whilst driving, whether it be a truck or car they deserve to have their vocational entitlement permanently revoked

You say that you wee seen by the police…not stopped.
If they had stopped you they would normally show you the video of you with your mobile phone…did they stop you did they show you the video ■■?
It could be that they were on their way to something more important like the ■■■■■ shop.

If you have just received a letter you could try and write and say that you would like photographic confirmation …were you the driver ? WAs it actually a mobile phone?
What eveidence do they have that you weren’t actually parked up.

I smell a rat…it might be worth your while just having a free initial consultation with a solicitor that specialises in highway prosecutions.

A police officer once told me that 80% of all speeding convictions could be avoided by relying on a technicality…

It won’t cost you anything and might just save you 6 points on your licence…we don’t live in a police state so don’t be hoodwinked by them.

You clearly realise that what you did was wrong…you have obviously learned from it but you didn’t cause a motorway to be closed off for 8 hours…don’t be too quick to surrender…

How so? It is not unreasonable to ask for the evidence.

Ignoring the barrack room lawyers, the guy who quotes the Senior TC’s guidance is correct. That’s what the guidance says. However, it was issued by the former Senior TC, and TCs may deviate from what is laid down if they see a good reason to. It also comes down to which TC it concerns… if you did it in the North West then it’s probably good news for you that Beverley Bell is no longer in post.

I got tugged a while ago for picking up my phone whilst driving, after speaking/grovelling to the copper i asked if I’d be reported to the tc, he told me it was at his discretion and after a 5 minute chat and lecture he said he’d recommend me for a drive safe course rather than points and fine, and this time he wouldn’t report me…

Lesson learn’t, I now own a plantronics voyager legend Bluetooth device, awesome bit of kit and hoghly recommended for full time drivers [emoji106]

I don’t normally agree with the holier than thou response but in this case what did the OP expect.

I was sitting at a Paris metro station this morning and there was a poster opposite showing a fare dodger getting collared with words saying that they weren’t giving cautions as they assumed it wouldn’t be the first time a fare dodging offence had been committed but just wanted he first time the person was caught.

I think most people on here were thinking something similar that it probably wasn’t the first time the OP had quietly used their phone just the first time caught. Given the lack of rozzers driving round the chances of getting caught are vanishingly low. so not much sympathy

Yeah tricky one that, I’d be asking for the evidence too. If they give you it, it serves you right and you’ll learn. If they carnt produce then you have got away with it but again learn from the close call. Keep us informed on the progress

Compared to what I’ve done behind the wheel and had done to me using a phone is chump change.

Asked for advice on what might happen, which he got, both anecdotally and based on guidance.

I’m not going to say what I think about the OP or his question, because quite frankly what I think doesn’t matter and the question has been properly answered. I’m just going to say silly him for what he did and good on him for owning up.

Now about you Hiesenberg I am going to say, while what the OP admits to may be terrible driving and completely irresponsible, (and may not, I’m being neutral here) what you have done is contemptible, despicable and criminal. Let’s say the OP followed your advice, they produce a video or a still photo of him holding something to his ear but not clearly a mobile phone. You then advocate him saying that he didn’t do what he knows he did.

That is lying to a police officer in the course of an investigation. A criminal act.

If he does it in writing that’s at best making a false statement and at worst purjury. His points, fine and potential suspension instantly become prison time.

Don’t try and wiggle out of it, don’t lie to get off. Take the punishment like a man and re-earn some respect.

Basically my first post on this was just jest. Beyond that: he shouldn’t cry if caught breaking the law… pay the fine & take the points. And never be dumb enough to spew it out all over the web… that’s a bit thick.

Its a mobile phone offence, no puppies run over or kittens squashed in the process. :unamused:
As for having to answer to the TC, its ridiculous. The guys already been punished with points and fine, what other country punishes someone twice for the same offence :confused:
