Absolutely no excuse to have a phone in the hand to ear unless for the purpose of a 999 call.And even then you’d get nicked.
I’m sure I read somewhere that a guy got done in a car pulled over, stopped safely on roadside with his engine running. This is the good old UK mate, any opportunity to make a quick buck and smugly justify it under the Road Safety agenda, have you never heard of ‘‘Safety’’ cameras for example.
Wrong buddy, you are legally allowed to use a hand held phone to dial 999 in an emergency. The only exemption for using a mobile phone.
I also have issues with the alleged claims driving whilst using a mobile phone to talk is dangerous holding it or even as bad using hands free. As I’ve said before they are already trying to educate everyone to not even use hands free as it’s not safe.
I used mobile phones every day as did most people many years before it was illegal and we all did fine and didn’t cause mass crashes or deaths. Obviously there will be the cases where it did happen but the majority didn’t cause accidents or deaths.
A typical example was Frank Wrathall a highly talented BTCC driver, he killed a cyclist in his van whilst towing a trailer with his race car on, he got sent down for it and it ended his BTCC career, now that same scenario I could have easily driven that vehicle whilst on the phone and steered it accordingly and still been aware of my surroundings.
Maybe a lot of it the fact these days people don’t seem to have any common sense, people see driving as a right, or driving is just something they do and have no interest in being as good as they can be at it.
I just don’t buy the reasons they say it is so dangerous especially since the invention of Bluetooth and voice activated calling.

If they had stopped you they would normally show you the video of you with your mobile phone…did they stop you did they show you the video ■■?
It could be that they were on their way to something more important like the ■■■■■ shop.If you have just received a letter you could try and write and say that you would like photographic confirmation …were you the driver ? WAs it actually a mobile phone?
What eveidence do they have that you weren’t actually parked up.I smell a rat…it might be worth your while just having a free initial consultation with a solicitor that specialises in highway prosecutions.

Asked for advice on what might happen, which he got, both anecdotally and based on guidance.

I’m not going to say what I think about the OP or his question, because quite frankly what I think doesn’t matter and the question has been properly answered. I’m just going to say silly him for what he did and good on him for owning up.
Now about you Hiesenberg I am going to say, while what the OP admits to may be terrible driving and completely irresponsible, (and may not, I’m being neutral here) what you have done is contemptible, despicable and criminal. Let’s say the OP followed your advice, they produce a video or a still photo of him holding something to his ear but not clearly a mobile phone. You then advocate him saying that he didn’t do what he knows he did.
That is lying to a police officer in the course of an investigation. A criminal act.
If he does it in writing that’s at best making a false statement and at worst purjury. His points, fine and potential suspension instantly become prison time.
Don’t try and wiggle out of it, don’t lie to get off. Take the punishment like a man and re-earn some respect.
The OP came on to the forum asking for advice…my advice to him was get some free legal advice.
You have said that it is ‘contemptible criminal and irresponsible’ to suggest that he asks for the evidence.
I don’t know how old you are but presumably you are older than 6 and should therefore realise that police officers are employed to prosecute people for breaking the law.
The majority of the time they do a reasonable job…but not always…sometimes they make circumstances fit.
You have decided that in this instance they have done the right thing.
My suggestion is that it is the Court that decides who is right based on the evidence available.
If that suggestion is a little tricky for you to comprehend then quite frankly I don’t care.
But people should feel comfortable about asking for advice on this forum and getting a view…rather than be bogged down by uninformed and purple comments such as yours.

I think perhaps the point in question is being missed.
The TC is involved because a vocational driver chose to break a well known law, that casts doubt on his suitability to be a vocational driver.
This is why the TC would not particularly be concerned about use of the radio etc - it isn’t an offence (Although it may create a different offence in certain circumstances).
Being a vocational driver is about conduct.
