OK in for my stupid question of the week.
If you get tugged driving an untaxed wagon what happens to you as the driver, ie points fine etc…don’t think its points but getting different answers (as ever)…no I haven’t been driving an untaxed wagon but I know where they are regularly taking them onto the road…just to clarify that is no valid tax on the unit. One of the units hasn’t been taxed since May and goes out every day!
No points, no fine, Vehicle Excise Duty is solely the responsibility of the vehicle keeper, and nothing to do with the driver.

i think as the driver u are responsible for the vehicle if i remember vehicle will be impounded and possibley liable for cost of the tax and release fee storage etc if u knew it wasnt taxed would u still take it out ?

The driver is NOT responsible, the duty to tax the vehicle is down to the Keeper (not the owner), as a driver who is not the keeper there is no responsibility. but the vehicle could be seized leaving you to make your own way home.
Same with failure to display, an employed or casual driver who doesnt own , or keep the vehicle has no liability

Which offence would that be? I have not yet seen an offence of driving a vehicle without a Road Fund Licence.

Dont be contentious Harry, after all we all know DVLA are not exactly known for being accurate at times so it is possible that they got it wrong
It’s a fine for the keeper, so unless you’re an owner driver nothing for you. There’s an urban myth about it being an offence to drive a vehicle without a tax disc, but nothing to be found on either the direct gov or vosa sites, it’s only a fine for the keeper. Most large firms won’t use a vehicle without a tax disc displayed. There is also a 5 working day grace to display a disc if taxed online

The law is all on the web feel free to research and if we are all wrong I for one will apologise , this has come up so many times and to date no-one has yet found an offence in law that says the driver is in any way responsible.

You should report the person who told you this to his/her Line Manager. It is totally unacceptable for DVLA to give out such wildly inaccurate information. Obviously the person who told you this had not been trained to do his/her job, and it is the responsibility of DVLA to train their staff properly.
Rikki I accept what you are saying. Just seems to me that the point of a forum like this is to help each other out, which you have done thanks, and not get a slagging just for asking the question

You’re right, it is the drivers responsibility that it’s legal, but it’s not a punishable offence for no tax, so you will just have to fight your concience over it i supose
yes there is, and it is down to the keeper of the vehicle to ensure it is displayed, I do agree that a driver should not take a vehicle out that may land the keeper in trouble. but at the end of the day the obtaining and displaying of VED legally is not down to the driver of a vehicle he is not the keeper of.

Yes you are, The insurance company may try to fight the keeper who is legally responsible, but as far as you as a driver (not keeper) are concerned your insured.

I would take an untaxed vehicle out on the road, I couldn’t care less as it is not down to me. And yes, provided there was insurance in place on the vehicle in the first place then this would not be affected in any way by the absence of road tax.
