Hi all, I’ve a query regarding daily rest interuption
Basically I get out of my truck at around 1.30 pm, go home then come back to collect my truck at 10.30 pm. Another driver already has my trailer hooked in , I put my card in at 10.30 take 15 mins other work then drive 35 mins to the ferry where I use rest mode til I’ve to board the ferry which takes 5 mins. I then put it on ferry mode for 2.5 hrs and leave the boat at 02.00 . Am I legal in thinking my shift starts at 2 am and not 10.30 when I put my card in? Thanks in advance for the help .Jonny
Yor shift starts at 10 30 pm or after a daily or weekly rest
I thought that would be classed as daily rest interuption as it totals less than an hour?

you can only interrupt a regular rest of 11 hours.

Do you have access to a bunk or couchette while on the ferry ?
As the ferry trip only takes 2.5 hours I’m guessing that you don’t in which case you cannot legally take advantage of the interrupted daily rest concession.

By my reckoning 9 hours rest then a further 2½ hours is more than enough to qualify for a regular daily rest period
I have to say though that I think the OP is pushing the rules to the limit

I thought the ferry rule was for someone that is in the truck on rest at the port waiting to boarding and disembarking the OP went home so he as finished a shift
No the boat doesn’t have either, I do sleep on it though that’ll hardly count then. Re 11 he regular rest , I thought that the way I was working it out I finished at 13.30 started at 02.00 therefore 12 hrs 30 rest with the interuptions
Here is it is have a look
- Any time spent travelling to a location to take charge of a
vehicle falling within the scope of this Regulation, or to return
from that location, when the vehicle is neither at the driver’s
home nor at the employer’s operational centre where the
driver is normally based, shall not be counted as a rest or
break unless the driver is on a ferry or train and has access to a
bunk or couchette.

I can see the way you’re thinking about it, but as you don’t have access to a bunk or couchette the discussion is purely academic anyway
Thanks guys , ill just pray I don’t get stopped til my card adds up again, I’ve been doin it the way I explained for the past 5 weeks so I don’t think mr vosa would like my card at the min
I think a few years back coffeehilc said that you can only use the ferry mode if the ferry was long enough to get 11 hours rest in plus movements

As long as you did not have more than 3 reduced daily rests between weekly rests then you will be ok

also the truck is not stationary some other driver is driving it

Makes no difference to the rest taken - no rule says that all the rest must be taken in one place

the driver is on rest but he as no truck the truck is not on the ferry the truck is not at the port some other driver is driving the truck rest periods can not be taken in a moving truck

What rule has been broken if the driver spends 9 hours of rest away from the truck (perhaps at home) and then a further 2+ hours rest in the truck ?

Rog the idea of ferry mode is the driver need to move the truck on and off the boat to show the movements. and that while the driver is on the boat his card would be in to show the 11 hours rest on or near the ports.
Where does it specify what distance it must be from the ferry?
ROG:

two move movements in one hour to get on or off the ferry or in and out of the port.
