Drink Driving

Hear one for you.
A work mate was driving on the M25 early hours of Saturday morning got a blow out, as he was sitting on the hard shoulder a car came to a stop then rolled back into his trailer. My work mate got the young lad out of the car drunk. He moved the car onto the hard shoulder and kept the keys. My work mate got the lad to phone his parents to get the car then he phoned the police to come and nick him.

My question would you do the same or would you let the parents deal with it. Sitting behind the computer I say phone the police, if I been there,not so sure. We all done stupid things when were young don’t think I have the heart to do it.

No excuse for drink driving at all. Phoning the police was the right thing to do. Although the car should have been left there to be impounded too, not getting his parents to come and collect the car. Then maybe he might learn a lesson when it costs a lot to get the car back.

I get the whole conscience thing and yes we were all young once but drink driving is not exactly an obscure crime it’s a deliberate decision.

Rationalise it by saying he did just call the parents but then what about next time? What if the lads pure stupidity cost someone their life?

The one at the the station is the evidential reading used in court. No amount of mitigating will get him off the DD charge.

Yes. A guy on his way to work at my place last Sunday got tugged on the M6. He got tested and blew marginally over but wasn’t arrested. Police said at that level by the time they get the evidential sample he would be below so it would be a waste of time. So they brought him into work and the other copper brought his car in.

Once the bizzies had gone he then got tested by company and blew over two times the limit on a calibrated machine. He was suspended on the spot but has obviously lost his job subsequently.

Police were called back but we’re “too busy” to bother with it again so this guy has lost his job but retains his licence.

minimum being guilty is a ban…unless your a cop/footballer/preist/sooty with a disabled family with a good brief/sob story.
joe bloggs with a guilty might as well shop around for a bus pass.

If you can Google & understand exactly what ‘mitigating circumstances’ means, then you will understand that they cannot alter the difference between guilty & not guilty.

There are several possible ways that a driver proven to be over the alcohol limit can still be not guilty. This is why we have a court decide & not just leave it to the Police !

For obvious reasons I am not going to point them out except for one . . . Which I consider the most difficult to stage if you’re looking to justify drinking & driving.

Completely correct, the calibration of the EBT back at the nick is purged etc, and is accurate, the Roadside breath test is an wether the person is under the influence… blowing 35 at the station is Drink drive, only mitigating circumstance really would be a spiked drink, on medication l.l but as Andrew says I doubt any of that would work and I’m sure the CPS will go for the harshest penalty … he deserves all gets

So basically your friend was pervting the course of justice by calling the parents to remove the car from the scene…

In many avenues of life it’s easy to just live and let live. Drink driving ain’t one of them. Definitely right to call the police. It sounds a bit daft because I’ve heard it so often. But I believe in the thought of ‘what if that drink driver killed my wife or child.’

Update, he finally got banned last Wednesday 15 months reduced to 12 if he takes the course, the case kept getting adjourned for one reason or another.

I suspect there was something else going on. Standard procedure (it’s clearly documented in the MGDDA form that is followed by police throughout the procedure) is that a reading of 39 microgrammes or lower will be NFA. It starts to get more complicated if back-calculation is used (e.g. when a long time elapses between the driving and the breath test), or if impairment (rather than simply being over the limit) is being investigated.
