Define clean driving licence

ok , so the job ad says clean driving licence , i have 3 points which expired (3,5 years old) but will be removed in 6 months, now i understand if something expired then is no longer valid so it doesnt count, so i have clean driving licence right??

I dont think its offically clean till the points are both expired and removed. But I think a company that wants a clean driving license would accept the fact the points have expired to be sufficent.

To me it’s just plain stupid. Why they are not removed after 3 years. This is idiotic just like two taps :smiling_face:

I don’t think a legal or official definition is available. It’s quite a vague and subjective area. I would say clean = no active points.

Why DVLA allow them to remain for a certain period I’m not sure - but when viewing your details via the new online system, they are cleared immediately upon expiry.

So you are saying after 3 years they are no longer in the system when you log in to dvla?

It’s because the court can backdate points to when an offense took place.

I see what you mean. If someone had 9 points and got caught again. By the time he goes to court some points may expire but the court counts recent points from the date of offence so you can still be banned

Here is what dvla say ,

  1. How long endorsements stay on your driving record
    An endorsement must stay on your driving record for at least 4 years from either the date of conviction or the date of the offence.

4 years from date of conviction
An endorsement will stay on a driving record for 4 years from the date of conviction if the offence:

is for reckless/dangerous driving - shown on the driving record as DD40, DD60 and DD80
results in disqualification
Example

Date of conviction 28 May 2011 - the endorsement must stay on the driving record until 28 May 2015.

4 years from the date of offence
In all other cases endorsements stay on your driving record for 4 years from the date of offence.

Example

Date of offence 10 June 2012 - the endorsement must stay on the driving record until 10 June 2016.

11 years from date of conviction
If the offence is:

drink driving or drug driving - shown on the driving record as DR10, DR20, DR30, DR31, DR61 and DR80
causing death by careless driving while under the influence of drink or drugs – shown on the driving record as CD40, CD50 and CD60
causing death by careless driving, then failing to provide a specimen for analysis – shown on the driving record as CD70
Example

Date of conviction 3 December 2009 - the endorsement must stay on the driving record until 3 December 2020.

Yes it does. After a recent thread about this self same subject I (got someone else :smiley: ) to check my details online. I have 3 points currently “active” and three that expired last November, they all showed on the database.

I’m not going to go out on a limb and give you an answer to that mate. I would say it depends totally on the Co and their insurers. Personally I’d say that once they’re spent then they don’t count, and I reckon that the archaic method of keeping points on your licence could probably be fought in court by someone with deeper pockets than me as it probably contravenes the rehabilitation of offenders act or some other such guff.

Is my licence clean? No points but a 14 day ban a few years ago ha.

You are going to apply for a driving job, but don’t have a license to show the company because you have lost it.

It’s not going to get as far as working out whether your three points are expired or not if that’s the case.
