Hi all . I need some advice please . Got caught in a van doing 68 in 60. Already have six points so will have 9 now. Is there any chance of not getting points if i go to court. I work as a driver and probably loose my job. I have 9 months old son. My wife dosnt work. I dont drive vans very often.drive lorries and i really didnt know it was 60 for vans on dual carriage( i know it,s not an excuse) but if i was doing 1 mile less i wouldnt get caught. I’m thinking if it’ s worth getting a lawyer. I’m devastated anyone had similiar experience maybe?
No mate. You will definitely get points.
I know a guy who had 27 points, he wasn’t banned but still had the points (and got massive fines too), so if it was putting you up to 12 then I’d go to court but not from 6 to 9.
Try and slow down, I’m no angel but you know you need your licence for your job, so don’t speed

What van was it?? Car derived vans are allowed to do 70, but dedicated van’s are only allowed to do 60…
Same with some ‘commercial’ 4x4’s, but I don’t know each and every one tbh
Merc sprinter. It’s done . I have a notice
.
Over six points will eliminate you from working at many places.
It is a stipulation made by many insurance companies - I have
seen the stipulation written in black and white.
Legal representation may be the best way to go and he/she
will probably explain your mitigating circumstances better than you can.

68mph in a 60mph zone is right on the limit, as far as I’m aware the police guidelines are that you should be allowed 10%+2mph which is 68mph.
I wonder if it would be worth querying the speed.
How long will it be before the previous points come off?

and some more advice from an ex-copper I know.
If you were clocked by a police vehicle…
Write in to the court without admitting any offence and formally request a full disclosure of evidence requesting specifically to see that the vehicle concerned has had its speedo (or other device used) calibrated before and after the incident and if the officer driving should have been wearing prescription glasses and if he/she is fully authorised to drive the class of vehicle in the manner it was driven on the day and for carrying out speed checks.
If you were clocked by a camera ask for sight of the images to see if there are other vehicles that could have triggered the device.
Any chance this could be dealt with by a speed awareness course?
I thought if you hadn’t done a SpeedSmart course within 3 years you could waive the points but pay for the course. Some insurance firms will put up with 9-11 points but not many
At firms I’ve worked at, it may have being difficult to have been taken on in the first place with more than 6 points, but once employed I’ve never known a driver be laid off for getting 9 or 12 points etc. Granted these were small firms doing European or traction only dock work with 20-30 trucks and not your large “blue chip” outfits.

Agree. Find out if your area has one of the these.
If not and you are 100% going to lose your job if the points were to go on then could be worth getting a lawyer to help fight your corner or find any loopholes
There is no excuse. If you did not take lesson b4 maybe that will teach you.
Get the points and penalty and stop moaning. Nobody did it for you.

Get a lawyer he should not have done that. He should have some balls like he had when he was speeding.
BTW Speed Awareness is offered to those with no record of previous offense.

How could anyone be so stupid as to get that many, surely he would’ve learned his lesson long before that?!
Where I used to work there was a bloke on 12 points and every week without fail he was amongst the top two or three for speeding when those in the office used to go through the Paragon tracker. Given that his license was his livelihood I always struggled to understand it. But his problem if/when he loses it.
sounds like you need a 2 peddle truck van /car … break and CLUTCH

not true I’ve got 3 points and i got offered a speed awareness course and that was doing 60 in a 50 in a class 2 (going down bluebell hill). i think it’s if yo haven’t had a speed awareness course in the past 3 years you’ll get offered one or points, you’ll find out when you get the Notice of intent to prosecute

Not true, I did a speed awareness course with 3 unspent points for speeding on my licence.
This is top advice from somebody who has contested a speeding offence in court ! TAKE THE 3 POINTS PAY THE £60 FINE! …
I can’t be clearer than that, if you go to court you will most defintley be found guilty & you will get more than 3 points & you will pay a bigger fine , regardless of what you think might happen, what an ex copper says or even a lawyer , explain the situation to your employer , see if there is a way of keeping your job but do not , I repeat DO NOT go to court ,
I contested 3 points & a £60 fine , I wasn’t speeding , I thought I had a concrete case against it …
I got 4 points & £485 fine after my court date …
