Court hearing for minor speeding

I agree with kemaro here. I am an ex traffic police officer so you could say I have a bit of experience. If they’ve sent you a ticket through the post they will have some sort of evidence and it will be plenty good enough for any magistrate to convict you. And if you take it to court and are found guilty you’ll end up with more points, a bigger fine and court costs as well. On rare occasions a court will offer other punishments other than points if it means you may lose your job but it’s a big risk to take

How were you were clocked? GATSO? Following Police vehicle? Laser gun?

Some have mentioned about a speed awareness course. If this had been a possibility he would have been offered it. Different areas/Police forces have different guide lines.
Commercial vehicle drivers are often treated more harshly than car drivers.

You seem to be the opposite to oh-so-many car drivers who think the speed limit for their car on a DC is 60.

IF you choose to take the solicitor route DO NOT use just any old high street solicitor, must be one who specialises in motoring law. However I back what Kemaro & BenBailey81 have said. Speeding is an absolute offense. I used to drink with a JP. He would tell me they would come down heavily on people they considered as wasting the courts time contesting an already proven offense.

Many times the defendant would stand up and say “I wasn’t doing the alleged 39mph (other speeds available) in the 30 limit, I was only doing 35.” They might just as well have said “yes, I am guilty of speeding” as that is exactly what they have just said.

i find it helps to have my satnav set to be chiming away if im 5 mph over the limit

adding points for speeding is the discretion of the court.
like it’s been said, Ask for advanced disclosure.
you will probably find that the 68mph that they are using to prosecute you has already had the 10% margin knocked off. Your actual speed was probably 75-76mph. If it hasn’t already been knocked off, The you will get the case thrown out, As you can then only be prosecuted for being 1.2mph over the limit.

It’s not about driving like your grandma, just observing the rules of the road.

I’ll admit, when I’m in my car or on my bike, then I might take a few liberties depending on location and time of day, but when I’m in the truck then I stick to the rules wherever possible, sure it may use a touch more diesel and wear the brake pads out a touch quicker, but that’s the fault of the rules and the roads rather than me, who’s just following them.

Because on a lot of single carriageways, there’s these things called hills, and you have to brake going down them because the exhaust brake is ■■■■■■ then you have to accelerate going back up them because gravity doesn’t want you to make it. :unamused:

Whereas, if you were ok to speed, you’d roll down the hill and use momentum to climb the other side

You can’t avoid that points because they caught you when you have that speed even you don’t drive van early.But you may consult with your lawyer may be you get some other solution for that.

I can’t be clearer than that, if you go to court you will most defintley be found guilty & you will get more than 3 points & you will pay a bigger fine , regardless of what you think might happen, what an ex copper says or even a lawyer , explain the situation to your employer , see if there is a way of keeping your job but do not , I repeat DO NOT go to court ,

I contested 3 points & a £60 fine , I wasn’t speeding , I thought I had a concrete case against it …

I got 4 points & £485 fine after my court date …

Yes but you didn’t appear personally at court which was the most important part of the advice I offered you at the time…

I wasn’t being patronising just stating a fact & genuinely trying to help the OP. My grasp of the English language is fine, you’ll probly trawl my posts now to find mis spellings. If I mis spell words it’s usually because I choose to.

Thanks for your advice. I really dont speed since i got 6 points. I was doin just under 70 thinking i can do 70.

You were caught doing an actual 68MPH. Given most speedos overread by up to 10% it is likely your speedo was showing up to 75MPH. Had you been doing an indicated 70MPH you would probably have been doing around 65MPH. Hardly smacks of someone who has learned their lesson from 6 points.

I doubt it. 6 points and the threat of losing your job didn’t stop you so what makes you think another 3 points will?

I realised that’s where you were coming from which I can respect but make sure you are right before going off on one & bandying insults around, particularly when it’s your only input on a thread.

I was merely pointing out that his first language doesn’t seem to be English, not that he can’t spell or use punctuation and good grammar which I couldn’t care less about.

I’d only ever point out someone’s wrong spelling to try & help the person not look stupid & not make the same mistake in future if they are open to help & not to belittle them.

As someone who has stood in front of a magistrate believe me when I say if you are not very capable with the language & a consummate debater then you MUST have a lawyer otherwise you’ll look like a ■■■■ & lose! (Yes I tried it, yes I lost & looked like a ■■■■ & yes I had a lawyer next time!)
