Hi guys worked for a shambles of a firm for a month and on starting they gave me ppe which was mostly second hand and not in my size . On Monday this week I told them to shove the job And returned all said ppe mostly unworn . Just seen wages and they ha e deducted around £300 so today I have to go and put a hand around the fellas throat . They where aware all the kit was second hand. My question is are the legally allowed to do this I didn’t sign any thing to this and when given a tick list I put the amounts down and clauses second hand or wrong sizes . All was previously given to a bloke who lasted 2 weeks … I may name and shame the firm in a new thread regarding the issues at the place with a warning to avoid like the plague cheers guys

What’s the break down on 300, what did you get for it
Why tick a box for something that don’t fit or second hand
Better off having a week on the sick when quitting that way you get the money for the work you have done without deductions and last weeks wage has nothing to deduct from, if you have only been there a month.
So I have heard anyway.

I haven’t seen the breakdown as yet . I ticked as I had received them but the was told both written and verbally these are not new and Not my size . The only things it would be fair to charge me for was boots that turned up after 4 days ish but unused as had my own new anti static and two pairs of anti static trousers they got after 2 weeks which one pair returned unworn

Rather than sticking your chest out and acting all neanderthal with the company, why don’t you have a reasoned conversation with them and ask them to breakdown the costs?
Also, as said above why sign for PPE that doesn’t fit and therefore not fit for purpose?
Just a thought!!
The company seems to want it all their own way.
If they want to charge you for the PPE then you are entitled to all new PPE, which becomes yours once you’ve paid for it. If you return it, they can’t charge you for it.
Companies are legally obligated to provide any necessary PPE, that must be in reasonable condition and fit for purpose. In this case, they have failed to do so.

Its their job to supply you with PPE, doesn’t matter how long you stay there.

By virtue of Section 9 of the Health and Safety at Work etc Act 1974, no charge can be made to the worker for the provision of PPE which is used only at work.

Yes they do. company owned by a 26 y/o who’s daddy brought him the company thanks for info
Is the deduction specifically for PPE that you have returned, or is that a penalty they might think they can impose for failing to work a specified notice period.
If its a charge specifically for PPE, then from Terry T’s post it looks to me (i am no legal expert) like you have a clear case to write to them asking for your correct pay, giving them 7 days notice of taking the matter to a small claims court.

Try thinking something sensible. of course I have had the conversation and they are sending me a break down of what they have deducted .i didn’t sign for any thing I claused everything and amended to the correct amounts given on a check sheet so they where fully aware of the issues . As the job was on fuel I had to wear the minimum of this ppe to be allowed on to the terminals

They can’t just go deducting money willy nilly for stuff. You need to have signed or it been in your contract if the clowns gave you one
You could contact the HSE with a copy of your payslip, clearly showing the breach of S9 of the Health and Safety at Work Act.
I’m sure they’d be interested and may pay a visit to the company. If they’re doing that what other corners are they cutting?

A phonecall to ACAS will get you free advice and information on exactly where you stand and what procedures you can take…not that I don’t trust what some people write on the internet!
Even if they did charge you you’re looking at:
£1 for a pair of gloves
£3-£4 for hi-vis vest
£5 for a hard hat
£20-£30 for a pair of steel toe cap boots.

These prices may well be correct, but that’s nothing to the point.
A company CANNOT charge for PPE in the circumstances described. It’s as black and white as that!!
