Charging for ppe when quitting

A company CANNOT charge for PPE in the circumstances described. It’s as black and white as that!!

OP PPE would have been a bit more than that.
It possibly went unnoticed by most, but he said he was doing fuel work. This means he would need flame proof, anti-static trousers and jacket. Same applies to a hi-vis, then you have oil-proof gloves.
It’s not unusual for all of this to cost £200-500, depending on quality, and how many of each item they provide

Hi guys worked for a shambles of a firm for a month and on starting they gave me ppe which was mostly second hand and not in my size . On Monday this week I told them to shove the job And returned all said ppe mostly unworn . Just seen wages and they ha e deducted around £300 so today I have to go and put a hand around the fellas throat . They where aware all the kit was second hand. My question is are the legally allowed to do this I didn’t sign any thing to this and when given a tick list I put the amounts down and clauses second hand or wrong sizes . All was previously given to a bloke who lasted 2 weeks … I may name and shame the firm in a new thread regarding the issues at the place with a warning to avoid like the plague cheers guys

Are they calling it “uniform”? If it has company logo on it, I’d bet that’s what they’re doing and most companies charge for that if you dont return it. No idea where you’d stand if that was the case though.

Yes mate all of the above it is more expensive than the normal ppe even though it was the cheapest of the cheap . That’s why a made a point of returning it all . If it would have been new and my size I would have lived with what I had used being deducted but I only wore one pair of trousers and that was over jeans due to the size and a hi vis long sleeve vest type thing

You could contact the HSE with a copy of your payslip, clearly showing the breach of S9 of the Health and Safety at Work Act.

I’m sure they’d be interested and may pay a visit to the company. If they’re doing that what other corners are they cutting?

No mate all ppe except 3 T-shirt’s that where too small and two sweatshirts that where too small

Before you get too involved with any claim for wrongful deductions, did you sign a contract of employment? hopefully not, because otherwise they are going to claim that the deductions are nothing to do with PPE but for you failing to give notice whether that is correct or not, in either sense of understanding the application of ‘correct’. Should they come up with a contract with ‘your’ sigature on it but a fake then the next move is down to the Police station with the contract since they will have forged your signature on a legal document. While none of this is really his business, if your account is strictly gospel then a letter to the TC would seem to be in order since the company’s behaviour would indicate that the ‘good repute’ attached to the O licence is at least questionable, and he needs to know that.

No contract was signed. in fairness they are a reputable company they won’t stoop to falsifying stuff. new young owner trying it on

sure i heard somewhere you cant be given/asked to wear clothing that was previously worn by anyone else.

Fight your corner mate companies try it on.When our place moved from paper vehicle defect cards.They wanted me to download an app on my phone for electronic ones .I pointed out its my phone not a company one.After a few minutes of arguing back and forth he finally relented and got me one for work.

Have all those . All the PPE needed for fuel work has to be anti static and flame retardant tho . Been driving 32 years mate always take PPE to new job .
