Car clamped at tesco

this is something that i thought was odd for a few reasons

  1. i thought clamping was illegal up here
  2. its private property
  3. it was in the RDC car park, why would tesco clamp it?
  4. how would it get clamped? there are no security patrols, only cameras which are monitored

it is possible that it was clamped by the authorities but again, why and how would they know if it was illegal unless they do random checks in car parks on private land :confused:

just a thought could the driver of the car put the clamp on themselves

no. there was a big sticker on the drivers door window. it was raining and i was still suffering from the shock of a day shift so i didnt wander over for a nosey to see what it was all about. it might still be there next time i am in there. its in the corner of the car park so as i dont go that far very often, i couldnt guess at how long it has been there. it could have been clamped today, it could have been weeks ago :confused:

When I worked at the hospital we had a problem with cars obstructing the entrance to A&E so we parked a spare car there with a clamp on it. Worked a treat :laughing:

Maybe a dumped car and it’s clamped whilst the owner pays up for leaving it on their property. Yes clamping is a nono here but dvla still do it. I dunno if the Council do it too whilst waiting on the truck coming to pick it up to take it to the council compound

If the RDC car park (or any car park for that matter) has unrestricted access to or from a ‘road’ then under the eyes of the law it becomes a ‘public highway’ and all aspects of road traffic legislation therefore applies. i.e. you can get done for drink driving, disqual driving etc and you can be clamped/immobilised by the authorities.

Wonder if he’ll get Clubcard points when he pays up? :wink:

I thought there was talk and legislation coming in about bringing some clamping back to Scotland all through strickly legislated.

A lot of the supermarkets were complaining about not being able to enforce any parking restrictions, go to a supermarket in Scotland and find all the disabled bays are full of healthy people and the disabled people are parked up at the back hobbling across the car park.

Although supermarkets cant clamp in Scotland. they can send out fines.I parked at Lidl in Dundee went in spent about £20.put my stuff in the car and walked to Driverhire,got registered and blethered about trucks and B… at VOSA.Fortnight later got letter from carpark operator demanding £45 soon or it would be even more just like speeding fines.Why do we bother working?

These fines are NOT usually legally enforcable going to web sites like this one pepipoo.com/ can usually find information and usually ways round these fines were you don’t need to pay.

Not sure think its to do with the car owner can’t be fined, it has to be the person driving the car, and since its a civil matter you don;t need to tell these companies who was driving the car.

Don’t pay it, its a scam and not legally binding, they can’t fine you, only a magistrate or the local council can do that, the worst they can do is take you to the small claims court, and they won’t do that for £45 cause if you defended the case by using the defence of the charge being excessive it would get thrown out and ruled in your favour. Your tactic now is to ignore all corespondance, no matter what they threaten, they’ll give up and go away and hassle someone else :sunglasses: .

has from last year the law has changed and you can still have your car clamped on land like tesco’s. Anywhere where a member of public can access with there car can be clamped or taken away

i think that is a good rule because far to many people on my beat got away with it last year “Because there car was not on the road etc etc” now they have changed it the buggers can have there car picked up

So would the above car be liable to be towed away for having no tax? I ask because the land on which it is parked is part of my parent’s property and is on their deeds as such. The tarmac in front of the car is a shared private driveway.

Has it got a National Trust sticker in the back window ?
