the rules state you have to pay back any reduced break by the end of the 3 rd week following the reduced break, and this has to be add to a full weekly break. so the way you have written it is correct. personally if i take a reduced break i like to pay it back the next week that way it don’t get too confusing
If you take a reduced weekly rest to 24 hours, you have to pay back the shortfall of 21 hours by the third week following, by adding the 21 hours on to any rest period.
hope this helps

Remind me never to do distance work where all these tacho rules start getting confusing.
Hi All,
Thank you for all your help…

i doesn’t matter if you do distance or not the rules are all the same, everyone should know the rules before getting behind the wheel of a truck," ignorance is not a defence" well thats what the judge would say to you if you messed up big time

Indeed, very important to know the rules.

No, it can be attached to any rest period of at least 9 hours, doesn’t have to be a full weekly rest. You could add it to a daily rest or a reduced weekly rest.
Exactly. If I reduced my weekend break to 41 hours this weekend, I could take a 13 hour break on Monday night and it would have been paid pack.

I know what you are saying and admit to being ignorant to it. Its just i’ve been doing local work for all of my driving days, its monday to friday, i very very rarely do anything more than a 10hr shift. And even in that 10hr shift, i’m doing well if i even get near 4.5hrs driving a day. The only rule i go by every day is to ensure i take my 30min break after 6hrs duty, although i do take at least a 45min just to ensure my 4.5hrs are reset on the odd chance i do go over. You might think its wrong for me not to be too bothered, but i don’t like to burden myself with all these rules when i know that i won’t even come close to driving time limits or not getting enough rest etc, in the job i do. Oh how i’ve lived a sheltered life so far!!!

You might never have to take a 66 hour break. The only time it would be required is if you did reduce to exactly 24 hours one week and by the time it came to be compensated for you had to take a full weekly rest.
Example
Week 1 - 24 hour weekly rest
Week 2 - 45 hour full weekly rest
Week 3 - 37 hour reduced weekly rest
Week 4 - 45 hour full weekly rest + 21 hours compensation = 66 hours.
Another example when 66 hours is not required would be,
Week 1 - 24 hour reduced weekly rest
Week 2 - 45 hour full weekly rest
Week 3 - 45 hour full weekly rest
Week 4 - 45 hour weekly rest made up of a 24 hour reduced weekly rest + 21 hours compensation.
The 21 hours owing from week 4 would then have to be paid back before the end of Week 7.
Another way it could be paid back is if you had 30 hours between shifts in the middle of the week and that could be a 9 hours daily rest + the 21 hours compensation.

24, 45, 24, then it’s 45+9+21=(75)

Which isn’t a rule.
The actual rule is a minimum of 15 minutes break before exceeding 6 hours work, which with POA could be more than 6 hours into your duty.

Just curious as to where “week 4” came from. I thought it had to be paid back by the end of “week 3”
Ie
Week 1 - 24 hrs
Week 2 - 45 hrs
Week 3 - 45 hrs plus 21 hrs owed from week 1 = 66hrs rest ■■
45 hours minimum weekly rest that can be reduced to 24 hours. But the reduced hours has to be made up by the end of the 3rd week ■■?
Cheers. Pete

The regulations, 561/2006, Article 8(6), say the end of the third week following the reduction not the end of the third week or week 3. The word following is the key and the end of the third week following a reduction in week 1 is week 4

i didn’t want to confuse the issue and was trying to make it easy, unless your doing agency work, i would of thought it would be difficult to add that amount of break onto a mid week break, i know i have never been able to do it, thats why i said what i did coffee, but as always you are totally correct
