90th. The 90 minutes is not up until the referee blows the whistle.

I have done 4:30 a few times and never had an infringement.

tachograph:
4 hours 30 minutes and 1 second only becomes illegal if the 1 second makes the tachograph record an extra minute of driving time, a digital tachograph will only record in minutes not seconds so theoretically on the type 2 digital tachographs you could go up-to 4 hours 30 minutes and 29 seconds and not get an infringement if the other 31 seconds was all the same activity.

Driving time is what’s recorded by the tachograph as driving time, if it’s not recorded by the tachograph as driving time it’s not driving time.

A few times I’ve still been in the process of parking or pulling up to stop after its clicked on to 4:30 and its remained on 4:30 even though I’ll have gone several seconds beyond the 4:30 mark but not by enough to make it 4:31…no infringement was ever recorded. On a type 2 digital tacho 4:30.01 is definitely not an infringement, at least not on any truck I’ve driven. As tachograph says, it’d have to go beyond 4:30.29 to become and infringement on paper, and even then its not the seconds that are an infringement, its the fact the tacho software makes it 4:31 because of its programming.

4:30:59 is ok, 4:31:00 is not

once had an infringment for putting my forename first :unamused:

I had one the other week for only taking an 18 minute break in a 7.5hr shift…card in at 19:00, break started at 23:32 & finished at 23:50 (obviously) with only 3hrs 40 driving…Booked off at 01:30. Our in-house system gave me 1 point for that…get to 6 and I get councilling!

I’m no mathmetician, but if you started at 19:00 and finished at 01:30 that’s only 6.5 hours, not 7.5!

Twice I’ve pulled up on 4:29, stuck the tacho on rest, and 30 seconds or so later, it’s flashed up “driving time exceeded”.

Yes,unless you stopped dead on 4:30:00 driving,if you went over 4:30:00,even by 2 seconds you’ve gone over your driving time.

I’ve had two infringements since digicards were brought in.
Both in London, stuck in traffic where it took over 2 hours to do about 2 miles up the road.
On both occasions, I pulled into the first layby on the way out of London I could find - and booked the 45 break. I didn’t get done, but I might have been if I’d tried to get all the way back to base, and done something silly like 6:35 driving instead of the half hour over it actually ended up being, by the time I’d reached Rochester Way on both occasions… :blush:

I think that’s only true with the first generation of digital tacho. In the 3 months or so of driving I did on the newer types, I have for example being sat on the road, indicating to pull into a truckstop when the tacho is already on 4:30. I’ve then turned right, in the gate, promptly parked and hand brake on, changed the mode etc and its remained on 4:30 because I hadn’t done more than 29 seconds driving in the 30th minute of the 4th hour. As you say, the old ones always clocked up one more extra minute after you’d stopped, catching many a person out.

Why Drivers think they have to do everything to the limit is beyond me.
Since when has it been a condition of being an LGV Driver to do 4.30 driving 6.00 WTD minimum rest periods etc etc without having so much as a tea break
Its not the TMs health thats going to suffer, he wont get the stomach ulcers because Drivers dont take care of themselves,by pushing themselves to the limit.

you broke the WTD as long as you did over 6hrs with only 18 mins probably

Guess I’ll get another point today then as I only had 22 mins break on the way back in a 6.5hr shift…and that’ll be another piece of paper they’ll want me to sign saying ‘has the infringement been a explained to you’!! Duly filed in the shredder! Can’t wait for next week when I’m in the Big Comfy Chair for my ‘talk’ on the subject by a bloke who thinks the minimum daily rest for drivers is 45 minutes…and apparently holds an International CPC

You don’t have to be making yourself poorly to get close to the limit. I don’t drive more than 2 &Half hours before taking a break, the times I’ve been on the limit is usually because of roadworks or some other hold up, just making it in my preferred ■■■■■■■■■■■■ bang on 4:30, never been picked up for it though.

You don’t have to be making yourself poorly to get close to the limit. 4.30 driving, then unload,then put it on a break.got a infringement coz I should have put on break straight away had 45 then tipped :unamused: just sign it and move on hardly crime of the century I for one don’t worry about silly little things like that its just keeping the office happy that’s all :slight_smile:

4hr 29mins extends from 00 seconds to 59 seconds. Likewise 4hrs 30mins 59seconds is 4hrs 30mins. This country is rapidly turning into a complete joke in its pedantry.
