Yes,unless you stopped dead on 4:30:00 driving,if you went over 4:30:00,even by 2 seconds you’ve gone over your driving time.
4:30 and 1 second is an infringement

After a driving period of no more than 4.5 hours, a driver must immediately take a break of at least 45 minutes unless he takes a rest period.
So how the hell can they say its an infringement?

I never just sign my infringements,they go on your record and if for any reason your place of work want to get rid of you they will use your infringements against you.
I’ve refused to sign infringements for when I went over my driving time when a car set on fire on the M6 and brought it all to a stand still and slow crawl.
By signing your infringement you are accepting you did something wrong,if whatever happened was out of your control then that wasn’t your fault so don’t sign.

4hrs29 and 59 seconds is before 4:30hrs
4hrs30 and 00 seconds is legal
4hrs30 and 1 seconds is OVER 4:30 driving time.
I’ve also had an infringement for this is aswell in the past, pure desperation trying to stop got it stopes dead on 4.30 and I was chuffed to bits only to get handed an infringement a week later.
The tacho itself is misleading because it doesn’t show seconds so people assume when they stop on 4:30 they are ok,but as stated above 4hr30 and 1 second is over

I had one the other week for only taking an 18 minute break in a 7.5hr shift…card in at 19:00, break started at 23:32 & finished at 23:50 (obviously) with only 3hrs 40 driving…Booked off at 01:30. Our in-house system gave me 1 point for that…get to 6 and I get councilling!

No, you can stop dead on 4 hours 30 minutes and it’s legal, the problem is that if you stop exactly on 4:30 the digital tachograph is likely to click over to 4:31 while you rest and that is an infringement.
But if the analysis software showed exactly 4 hours 30 minutes driving it’s not an infringement.

4 hours 30 minutes and 1 second only becomes illegal if the 1 second makes the tachograph record an extra minute of driving time, a digital tachograph will only record in minutes not seconds so theoretically on the type 2 digital tachographs you could go up-to 4 hours 30 minutes and 29 seconds and not get an infringement if the other 31 seconds was all the same activity.
Driving time is what’s recorded by the tachograph as driving time, if it’s not recorded by the tachograph as driving time it’s not driving time.

If you stop driving on 4:30, and do not IMMEDIATELY put it on break (ie it registers 1 minute or more of other duty) then it is an infringement. Not complicated, is it?
If this wasn’t the case - then it ain’t an infringement and don’t sign it. Simples
