WTD issue - is it legal?

In my last job i had a couple of days starting at 0600. One drop and back to the yard for 1300.

Then i was told rest up and prepare for a 0130 start in the morning. I guess it is BUT very difficult to get some sleep as it has mucked up one’s sleeping pattern. Left the job a couple of weeks later but would like to know if firms can do that.

Unless your contract of employment said otherwise then I’m afraid it is legal.

It’s an awful way to work but nonetheless legal :frowning:

Thx for the reply - i thought it was. Hell of a job trying to get the sleep in if one starts at 0600. Did the right thing leaving!!!

I agree, if the start times vary enough you can be walking around like a zombie after a week or two :frowning:

Heard hoyers shift pattern is bit like that all over the place. And they wonder why accidents happen.
And good for you walking out of the job pity many more dont follow you out the door

Are you saying you worked 6.00-13.00 and then back 10.5hrs later at 01.30 or was the 01.30 on a quite different occasion
If the former, you’d already worked 7 hrs and your 24hrs would mean you’d have a short day if you then started at 01.30!

Finishing at 13 00 starting again at 01 30 is 12 half hours off not 10 n half as above
Could be done I guess as you’ve had your minimum rest of 11 hours but I wouldn’t do it

Yep typo.
It’s the work in the 24 hour window of 0600-0600 that means if, and we’re not sure what the OP means, but if it was a 1.30am start, they’ve still through to 0600 to consider

They may have an opt out agreement in place.

Having said that, no-one’s getting fined for a WTD infringement anyway :slight_smile:

We’re waiting to find if it all happened on one, if so the problem is drivers hours
As you say, if it was a later change of shifts then it’s WTD and contracts :grinning:

Having a Daily Rest resets the hours counters under EU Rules.

It certainly used to be that hours were counted on a rolling 24hr basis, but that ended many years ago.
It used to be that if you started work at 00hr01 did a 9hr drive over 10hrs, had a daily rest (ending 19hr-ish) and started again then you could be doing well over 10hrs drive in “a day” and be illegal, but that is no longer a problem.
