I’m just questioning the rule about ‘30 mins breaks for 6-9 hours of work’ with the below scenarios, help would be appreciated…
The whole shift doesn’t go over 3 hours driving, so just assume work as either other work or driving,
Keeping it nice and round, we’ll assume clocking in and starting tacho at 0:00…
0:00 - 04:30 work
04:30 - 05:15 break
05:15 - 12:00 work
now then, the last section of work needs a break in but my question is that does it have to be 30 mins or can you get away with 15 mins?? (taking this break at say 11:00)
I think it is 30 mins because the gap from 05:15 - 12:00 is over 6 hours and even taking 30 mins off still is over 6 hours therefore 30 is needed… but talking to other drivers at work they think a 15 is ok there…
my argument was that the length of work is 6-9 hours so a 30 min break is needed…

The total work for that shift is over 9 hours so total breaks of 45 mins are required = OK in that example
Breaks must be at least 15 mins = OK in that example
No mobile worker shall work more than 6 hours without a break = NOT OK in that example because 0515 to 1200 is a period of over 6 hours
A 15 min break is needed at 1115
Reduce 1st break then have the remainder later in the shift - that could be 20 mins then a further 25 mins for example

You need to start a new 15 minute break no later than 11:15, that’s six hours from the end of the previous break.
The fact that from 05:15 to 12:00 is between 6 and 9 hours is irrelevant, the 6 to 9 hours referred to in the regulations is total working time over the shift

No - another point which is often misunderstood
There is another aspect of the RTD rules which is the total amount of breaks required for the working time done in a shift
It is a choice of two but not both together …
If the working time in a shift is between 6 and 9 hours then a break(s) total of 30 mins is required
OR
If the working time in a shift is more than 9 hours then a break(s) total of 45 mins is required
There are different rules for the max time between breaks and for the total amount of break required for the whole shift
