You won’t get a fixed penalty for WTD infringements but that doesn’t mean the WTD can be ignored, your company will most likely be complying with the RT(WT)R and will issue infringements for none compliance.

Yes absolutely he could, the fact that the DVSA aren’t particularly interested in enforcing the WTD at the road-side doesn’t stop it being law.

Whilst a recent FOI request showed that no one individual / Operator has been prosecuted under the WTD, the Fine Level is Level 5 - £2500 at Court!
Traffic Commissioners will ask an Operator, at a PI, certain basic questions on the WTD - don’t get them wrong.
