Hi peeps,
New here, passed cat C late last year, managed to get a full time job after 2 months on agency and am now suffering transport manager induced migraines from trying to get my head round the WTD.
I believe I already know the answer to this but would like clarification from someone who is sure, as the offending transport manager keeps telling me I’m wrong and makes me sign little bits of paper to say I’ve been a very naughty boy.
Minimum amount of break which needs to be taken within a period of 6 hours driving/other work to comply with WTD = 15 mins. True or False?
TM swears blind it is 30 mins. I believe he is wrong.
One more question, if I may.
Given that my assumption above is correct, is it the case that once the 15 minute break has been taken, WTD slate “wipes clean” and you begin your merry way on the next 6 hour instalment of life? eg start 0600 15 min break at 0800 satisfies WTD so you are now able to carry on working until 1415, driver’s hours permitting, without WTD concerns?
A wise old driving assessor told me this was true but whenever I mention it to the TM he looks puzzled then makes me sign more infringement records.
Regards, DB

He is, it is only 15 minutes

You need a second 15 minutes at or before 9 hours working time,
PLEASE IGNORE THIS PART AS I WAS SEVERELY REPRIMANDED and got a Coffeeholic type infringement…
Don’t forget breaks and POA do not count as working time. Driving and other work do. That is where the confusion comes in with your TN advisor (Me) and your silly TM

He is. He needs to go on some kind of training course. Have a look at this thread and see the post from nick2008 which contains an email from the DfT confirming it is 15 minutes and not 30. I would not be signing any more bits of paper if I were you.

Correct. Once you have taken 15 minutes for the WTD you do not need a further WTD break until you reach another 6 hours work or just before the end of the shift, whichever comes first.
Wheel Nut:
You need a second 15 minutes at or before 9 hours working time,
No you don’t. There is nothing in the regulations which stipulates a break at 9 hours, only at each period of 6 hours work or before the end of the shift.
If you are doing between 6 and 9 hours work then Section 7(2) from the regulations applies. However if you are doing more than 9 hours work then Section 7(2) no longer applies. So, you ignore everything 7(2) says and instead apply Section 7(3), which means no requirement to have 30 minutes break within 9 hours and and instead have a total of at least 45 minutes within the shift.

I shall beat myself under the covers after I have edited my post
Much obliged for the answers chaps, I shall eat the next infringement record I am presented with!
