working time directive

Hi can anyone answer my question as my transport manager an i are arguing about this and i believe am correct…
I was told during doing my driver cpc tacho course that if you took a 15 min break before your 6hr wtd directive that would enable you to work upto 9 provided you take the adequate break before 9 hrs!!! Let me know please

Yes you are correct that 15 minutes is the legal minimum for 6h working time. Some companies like to see 30 minutes and you should adhere to company policy if it exceeds legal minimum.

Company policy is increasingly wrong though, how many times have you seen company policy saying that you must only strap the rear pallets. This wont help you now when VOSA and BAG etc. now want to see every row strapped.

Sorry but it sounds like you may have been told wrong or misunderstood what you was told, though it really depends on the length of the shift.

Forgetting about any required driving break, with a 15 minute break at or before 6 hours working time you could potentially go well beyond 9 hours before having another break.

Lets say your total shift was 13 hours and started at 06:00, you would need to have a total of at-least 45 minutes break during the shift, you could have 15 minutes at 6 hours working time 12:00 to 12:15 then another 30 minute break 6 hours after the end of the last break which would be 18:15 to 18:45, then finish work at 19:00.

Of course that’s only one example but the point is that with a 15 minute break at or before 6 hours working time there’s no stipulation to have another break at or before reaching 9 hours working time or 9 hours shift time unless of course that’s the total length of the shift.

Sounds like a DCPC trainer almost got it right AND the driver listened :wink:

But of course the driver may not have relayed the full explanation given to him by the trainer and the trainer may well have been absolutely right … which appears to be a first on trucknet :smiley:

That’s half right and half wrong.

You are correct in thinking that you only need 15min at the 6h point.

However, you do NOT need any more at the 9h point. Nothing in the WTD specifies the amount of break you must take before exceeding 9h of working time. It does specify that if your shift exceeds 9h of working time that you must take a break (or breaks) totalling 45 minutes but it does not specify when in the shift they must be taken, you must just be sure not to fall foul of the “you must not work more than 6h without a break” rule.
