Working Time Directive

Obviously WTD affect all industries, but are the following rules regarding daily rest specific to driving or again, all industries??

The standard daily rest requirement is 11 hours within a 24 hour period. This means the rest must begin no later than 13 hours after the duty has begun.
You can reduce your daily rest to no less than 9 hours within a 24 hour period up to 3 times in a week

Does the daily rest period go from 0000-2359 or any 24 period from the start of work, ie 0730-0729 if your start time is 0730?

And if this does apply to all industries, then how would volunteering to do overtime affect this? Would you be exempt from it??

Reason i ask is, there a some shifts in my place of work (not the transport industry), are 0730-2100 (longest shift available) creating a daily rest of 10.5 hours. There are never more than 3 of these per week, so all is ok.
But what if someone volunteers to extend one or more shorter shifts on another day, ie 0730-1730 to a 0730-2100, giving them possibly more than 3 reduced daily rests??

Is this allowed or do the same rules in driving apply to everyone??

Is this a wind up? :open_mouth:

You appear to be quoting the EU Drivers Hours 561/2006 rules - not the WTD, but your quote isn’t right anyway.

SO I would say the rule you have quoted applies to drivers using tachographs only and not factory/shop/office workers etc.

That’s what I wanted to know, so thanks.

As said you’ve referred to the drivers regulations so it’s irrelevant to factory/warehouse workers.

As far as the WTD is concerned we don’t all work to the same regulations, drivers work to the Road Transport (Working Time) Regulations 2005, factory/warehouse workers work to the Working Time Regulations 1998.

A job which does not come under EU driving tacho regs is only subject to the normal WTD which can be fully opted out of

The normal WTD does not require by law a worker to have breaks or rest of any kind
