If I am scheduled to work 6 days in a week ( ie mon to sat) and after the fifth shift I have worked 53.5 hours ( breaks not included just driving and other work ) would I get an infringement if I phoned in sick on the sixth day because 8 hours would be added as per the rules?

Working over 60 hours in a fixed week is against the rules but as it generally ignored then its up to you
The 8 hours are only added to count towards the average 48 hour week over the reference period, it doesn’t make any difference to the 60 hour week.
So no you won’t get an infringement because you won’t have failed to comply with any regulations, but a day off sick will count as 8 hours towards the 48 hour average over the 17/26 week reference period.
Phoning in sick on the day is not usually the best option for a driver, it depends on your job but in many driving jobs it will leave the employer with a lorry standing idle, so the better option would be to let your employer know in advance that you won’t be able to do the last shift because you haven’t got enough hours left.
