I am wondering anyone can look at the following for me as I have refused to work sunday the 19th of December because I have not being taken the correct weekly rest period but my boss tell’s me that I can work it cause the relaxation of the drivers hours. He has in so many words said that I am going to be sacked for not working it. I think I will be informing with the company name to vosa at a later day.
Week 3 monday the 6th was so many hours after being stuck on the m8 all day and had to get off to park up in a secure park as I was loaded with whisky.
I don’t think that I should have been working Saturday the 11th as I had a reduced rest the week before but he still want me to work Sunday the 19th which would have been another reduced rest. Think its has cost me my job telling him that I couldnt do so hope I am right.
You required a full weekly rest for week 3 so should either not have worked Saturday 11th or Monday 13th. If you work this Sunday that will be the third consecutive week with only a reduced rest period.
That answer is based on the normal driving rules and not the relaxed version. Even taking into account the relaxed version due to the bad weather your boss is still wrong about you being able to take another reduction this week.
Postponing the weekly rest requirement until 23:59 on Friday 17 December, at which stage a driver has to take a normal weekly rest of 45 hours.
Notwithstanding the postponement of the weekly rest requirement, a driver must take a minimum rest of 24 hours beginning no later than the end of the 11th day since the end of his last weekly rest period.
So if under these temporary regulations the reduction in week 3 is legal then you have to take a full rest of at least 45 hours this weekend, based on the above quote, as today is Friday the 17th.

You haven’t posted for ages but couldn’t wait to post on ‘my mistake’. That’s just won me a bet with another TN member.
Doesn’t change the fact he needs a full weekly rest this week and if he is expected to work Monday then he can’t work Sunday, which was the actual question.
I don’t know what the relaxed rules are concerning reduced weekly rest compensation (anyone got a link ) but under normal circumstances whether or not you can legally work Sunday 19th will depend on what time you finish, you would need to start a regular 45 hour weekly rest sometime before midnight, if you can do that then it would be legal for the normal regulations.
But like I say whether or not the relaxed rules will allow you to work Sunday 19th and still work Monday 20th I don’t know.
Thank you for the comments. I would have probably had to start at 8am on sunday the 19th and finish around 4-5pm then be required to start on monday at 7am.
