Hi guys, I’m about to change jobs and this weekly rest is confusing me.
Is the following legal in week 2-
Week 1:
Mon-wed- off
Thurs- work
Fri-sat- off
Sun - work
Week 2:
Mon-sat - work (new job starts Thursday)
Sun - off
Week 3:
Mon - off
Tues-sat - work
Sun - off
Week 4:
Mon - off
Tues-sat - work
Sun - off
It depends on your start and finish times but it seems unlikely that it would be legal.
You’re working Sunday to the following Saturday, if there is more than 144 hours between weekly rest periods it’s not legal.
You must start a new weekly rest period no later than six 24 hour periods (144 hours) from the end of the last weekly rest period.
A weekly rest period is a regular 45 hour weekly rest period or a reduced weekly rest period of 24 hours or more.
Hmm, doesn’t look right to me either. The Sunday of week 1, or the Saturday of week 2 will very likely cause you to run into an issue. What are your start times and normal approx. finish times? The last thing you would want on a brand new gig would be a pretty serious infringement for 7 day working your very 1st week. Not a great look. Can you speak to new employer and explain the situation?, or ditch the Sunday of week 1 as you’re leaving anyway. Personally I’d put new employer in the picture asap.
