Waiver Working Time Directive **

Just starting new job soon and the company asked me to do 5 days of 12 hr shifts and some weekends, been asked to sign waiver for working time directive but im not sure in depth what the small print means.?

can any one give me information in what i can do to keep my self legal and within the law.?

1.Do my breaks only need to comply with drivers hours?.

2.90 hours driving over the fortnight how many hours can you work if your not driving.?

3.I know i dont need to comply with wtd breaks, can i for example work 8 hours straight doing 4 hours driving and 4 hours other work then take a 15/30 or 45 minute break. knowing that before the that wtd would be chasing me to take a break…?

4.Do i need to keep using POA when waiting to get tipped or leave it on other work to keeping my hours down.?

You are going to come under the Road Transport Directive and the waiver you mention is to opt out of the night time limits of a maximum of 10 if your shift is between the period 00.00 and 04.00.

  1. Your breaks need to conform to 561/2006 and RTD

  2. 90 hours driving over any consecutive fortnight is contained in the regulation 561/2006, not WTD / RTD

  3. You do need to take a break after 6 hours, this must be 15minutes, you do not need to take a break because of the 561/2006 regulations.

  4. That depends on your employer, If it qualifies for POA or On Call it also qualifies for a break

Assuming this is a driving job If they are asking you to sign a waiver for the WTD for mobile workers they are asking you to sign something that doesn’t, or shouldn’t exist. You cannot opt out of our flavour of the WTD, you can opt out of the 48 hour limit for the regular folks WTD.

What they may be asking you to sign is a waiver to the night time working limit of 10 hours in 24 hours. This is allowed for our WTD and is the only waiver/opt out allowed.
