VOSA prosecuting over DCPC

my daughters boyfriend was stopped by VOSA at Crick last week while 2 manning a truck for his agency.when he was asked for his Drivers CPC card,he told them he’d passed part 2 so far,but VOSA man said as he passed his Class C LGV test in April 2010,he’s not allowed to drive until he has got the full DCPC! this is news to his agy and his family firm he works for in the summer months,and VOSA are now prosecuting him,(fine up to a grand they told him),and he has to take his part 2 again ffs! is this right?

I’ve no idea why he would need to do the module 2 again but the rest is correct.

The only drivers who are exempt from the initial Driver CPC are those who had cat C1 or above on their license in September 2009 and therefore have grandfather rights.

Didn’t they give him a fixed penalty when he was stopped ? :astonished:

I think all theory tests are only valid for 2 years so if he did mod 2 in 2010 then it could be out of date

I know the basic theory and HPT are only valid for 2 years

This is actually quite common and often down to misinformation but will be much less common after Sept 2014 because ALL LGV drivers driving commercially after that date will have a DQC whether from passing the initial or from completing 35 hours of periodic dcpc training

Is it possible that somebody has got confused and it’s really initial DCPC module #4 that’s missing?

There is one thread on here stating that the driver got a £30 FPN for not having the required initial dcpc and then this one stating that its a fine of up to £1000

I do wish VOSA would make up their minds !!

Quick question…

I hold a PCV & LGV…where do i stand in relation to cut off dates?

Would i be correct in thinking that i would not be able to drive a PCV commerically after 2013 but would be ok to drive LGV’s until Sept 2014?

Only have 2 modules left to do…

he passed it around Feb 2010.he’s just informed me his uncle who he works for is going to pay for his full DCPC now :smiley: i will post on here the outcome with VOSA.

Your post seems to prove my point about how dangerous it is when anybody second guesses the action that an enforcement officer will take in a given situation.

Let’s be fair… based on the first ‘outcome’ of a £30 FPN, you’d probably have given that as gospel advice to anybody asking about the outcome of for not having an initial DCPC.

However, on another occasion the (different?) officer has decided on an entirely different course of action, so that should serve as a warning that with most offences there are a range of possible outcomes, including whether the officer decides to take any action at all.

Yes, of course we’d all wish for a consistent approach to enforcement, but it’s bound to vary depending on people and circumstances.

If you do not complete all 35 hours by 09/09/2013 then your PCV commercial driving entitlement is SUSPENDED until you do

If you complete all 35 hours at any time between 09/09/2013 and 09/09/2014 then you will get issued with a DQC covering both PCV & LGV until 09/09/2019 and your PCV commercial driving entitlement is re-instated on completion of those 35 hours

the lad hasn’t heard anything from VOSA yet Rog. is there a time limit on this sort of thing?

I would imagine 6 months! Pretty sure thats the limit for prosecutions! but I could be completely wrong

That’ll sort out those who reckon they’re not going to bother with the DCPC.

can anyone help,whilst employed by wincanton containers at felixstowe i took part of my cpc,i have completed all but the last 14hrs, i want to complete this last 14hrs,therefore can anyone tell me if i have to take another full course or can i just take the last 14hrs,if the later how much is this likely to cost me.

If you’ve already done 21 hours of periodic training you need to do just another 14 hours, the 14 hours can be done in two sessions of 7 hour each.

You can check how much periodic training you have accrued here, if you haven’t already you will need to register before you can check how much training you’ve done.

How much you will have to pay per 7 hour course will to some extent probably depend on your location.

There is no such thing as a set periodic course of 35 hours but many companies have a course of 35 hours which they say is THEIR periodic course

My guess would be that Wincanton have their own set of approved 35 hours and call it a periodic course leaving drivers to believe that they need to complete that specific 35 hours
