Urgent question quick answer please!

I think I know the answer but I thought I’d check, can I take a daily rest while someone else is driving if I’m in the bunk asleep?

Short answer no

So am I.Not legal if it isn’t.

no

The 2nd driver has to be present in the cab for your shift except for the 1st hour of it. The regulations are on the safety and tacho part of the forum.

Correct. If you are double manning the vehicle must be parked up for 9 hours for both drivers to REST

A second man can take a break while the other driver is working. The first 45 minutes of POA is classed as BREAK due to inconsistencies in the VU and Analogue Units

As long as you have some reductions left, otherwise you stay put!

Yes, getting a lift back to the yard should be recorded as other work.

Getting a lift anywhere would be work, not just the yard, unless going back to the same place to resume work in the morning.

Can getting a lift in those circumstances also be POA?

Could also be break, but whatever you record it as you’re still at work.

Can it?

  1. Any time spent travelling to a location to take charge of a
vehicle falling within the scope of this Regulation, or to return
from that location, when the vehicle is neither at the driver’s
home nor at the employer’s operational centre where the
driver is normally based, shall not be counted as a rest or
break unless the driver is on a ferry or train and has access to a
    bunk or couchette.

Yes.

Would that only be break if under double manning rules?

How would you be under multi manning rules if you have been collected because you have run out of driving time?

Ok so not under DM rules

How do you explain what is stated in this quote from 561/2006 ?
