Unpaid "lunch breaks"

Hi, my employer deducts 1/2 hour from our pay every day. I know most companies do this - but he insists that the half hour unpaid break MUST be taken during your 45 minute rest period (and must not be taken at any other time outwith the 45 minute rest period)
This seems to me that it is just a convenient way for him to deduct 1/2 hour pay each day during a break which we are legally bound to take anyway (and it is usually taken in a lay by somewhere).
Is this normal / legal??

The fact that your employer stops you half hour pay for a 45 minute break seems fair enough to me, I think you’ll find that most transport companies don’t pay for the first 45 minute break so I’d say that you’re onto a winner there mate :wink:

completley fair durring the course of your 8-12 hour shift that the break is unpaid …goes with every kind of job i know

unpaid breaks!!! never heard this before, my last employer paid them and so does my current employer!!

I loose an hours pay for breaks, so normally have a 45 when due then a 15min coffee break later in the day when I’m starting to feel a bit knacked so half hour deducton ain’t bad really :wink:

I believe it is standard procedure throughout the industry. It also happens in some factories when workers have to clock off for mugga

My understanding is that your 45 minute drive time break is one that you legally must take therefore you MUST be paid for it and I have never seen anything that states that an unpaid half hour break imposed by your employer MUST be incorporated into your 45 minute drive time break??

There’s no law that states that the 45 minute break must be paid and I’m reasonably sure you’ll find that most companies do not pay for it.
As far as I can see your boss is perfectly within his rights to insist that the 30 unpaid break be taken as part of the 45 minute driver break.

The only thing that your company are doing that is not normal is in only stopping you 30 minutes pay when I think you’ll find that most stop 45 minutes pay :open_mouth:

Never been paid for the first 45 and firms dont pay agencies for the first 45 either. I would keep quiet at work incase he stops paying you for both of them :wink:

Norbert Dentrassangle dont pay you for your hours break, and to be fair why would any company pay for breaks :wink:

Please don’t take this the wrong way but I think you would be best to STFU and not rock the boat before you become very unpopular with your workmates when the boss fixes this problem by not paying for 45 minutes instead of just 30.

There are very few jobs in any industry that don’t deduct breaks/lunch and so on from the pay.
