Hi… ok… here is my question
Newbie LGV CE driver {passed test 15yrs ago and just coming back into it}
I start at 05.00am
I get out the yard at 06.00am
I drive for 4hrs - time now is 10.00am
By this time I have attended work for 5hrs
I take a 45mins tacho break - time now is 10.45am and I have attended work for 5.75hrs.
Once i trip past 6hrs into the 6hrs - 9hrs time period DO ? i need another 30min break ■■
I also guess that once I pass the 9hrs - 12hrs period I need a 15mins break

For a shift with a total working time of more than nine hours you need a total break/breaks of 45 minutes, you’ve had this with the 45 minute driving break so all you need to do now is make sure you don’t go over 6 hours working time from the last break before taking another 15 minute break.
In your example you completed a 45 minute break at 10:45, for the working time regulations you will need another 15 minute break no later than 16:45 when you will have done 6 hours working time from the end of the previous break, as driving breaks also count as breaks for the working time regulations, if you reach 4½ hours driving time before this you will need a 45 minute driving break which will rule out the need for a break for the 6 hour rule.
As long as you comply with the 6 hour rule and have the total amount of breaks required for the shift length there’s no other requirement to have the breaks at any point in the shift, you don’t necessarily need a break between 6 and 9 hours or between 9 and 12 hours.

The rules for the working time breaks are:
Up-to 6 hours working time.
- No break is legally required.
If the shift is more than 6 hours working time but not more than 9 hours working time.
- A total break/breaks of 30 minutes is required, this can be taken in 2 parts of 15 minutes each and at-least 15 minutes of the 30 minute break should be taken before going over 6 hours working time.
Or (You are legally required to comply with either the rule above ↑, or the rule bellow ↓, but not both)
If the shift is more than 9 hours working time.
- Total break/breaks should be at-least 45 minutes and at no point in the shift should you do more than 6 hours working time before having a break of at-least 15 minutes.
- So for the 6 hour rule a 15 minute break should be taken
- No later than 6 hours working time from the start of the shift
- And*
- No later than 6 hours working time since the end of the last break.

Breaks for the working time regulations (RT(WT)R 2005) can be split into separate breaks of at-least 15 minutes each and cannot be taken at the immediate start or end of the shift.
Driving breaks count as breaks for the RT(WT)R and where appropriate breaks for the RT(WT)R count as driving breaks.
