TM reckons i can run over 4h 30m in depot?

hi all. so i get back into depot tonight with a load to get tipped tonight at 4h 28m driving time. i go into office and say to TM that if i put trailer in place for tipping, i’m going to run over my time. No problem he states, just run it to 4h 32m, do a printout and state your on private ground (the depot). I said to him, “no danger, i’ve been fined previous for running over” and he says “do a printout and we’ll put the explanation in with your file and there’ll be no problem”.

needless to say, i just dropped trailer round corner so shunter could put it in place. Parked up and pulled card at 4h 29m so where do i stand on this with VOSA, legally, if i had run over my time?

Putting the trailer in place for tipping would be part of the same journey so would count towards your driving time regardless of the fact that it’s on private land, where any part of a journey goes onto public roads the whole journey counts towards your driving time including any off-road driving.
Although you would have only been a couple of minutes over your driving time what’s the point of getting infringements on your card when there’s no need to :confused:

Having said that I suppose you could wait a few minutes and put the tachograph on out of scope, no-one’s going to know it was a continuation of the same journey but again why not just let the shunter do it :slight_smile:

As far as I’m aware you used to be able to run “out of scope” when on site/ private property but that dispensation ended years ago, so you were technically correct not to exceed the limit. Would your TM have paid any subsequent fines?

Now back in the real world and depending on what type of Co you work for I’d have been tempted (assuming it was at your shift end) to pop the card, put the trailer on the bay and leave it up to the Co to explain the missing mileage if necessary. Of course if your Co is a box ticking type of place that may not be an option.

the maoster, i said that to him, a) will you (the employer) pay any fines and b) he said never to run around the depot without the driver card in.

sound’s like he’s covering his arse while getting me to get infringements. printout on the company file or not, i’d still get the fines if VOSA popped in and checked records and he’d be denying all knowledge. cheers lads!!!

I’m surprised he didn’t just tell you to pull your card.

we’ve been told on no uncertain terms, no running around depot with cards out. reckon the managers will have to explain missing mileage and if no card in, it can’t be pinned on driiver.

goalposts move to suit them all the time Mike. In future, i’ll pull up before the depot, take another 45 break and run into a 10.

its still in the regulations, i use it occasionally when doing internal loads on a big recycling site where we are based, never been a problem when i have been checked. The thing is you can do more than one journey in a day and that’s where most people get it wrong.
