Taco question (15hr day)

If I work more then a 15hr day will this show up as an infringement so long as I have not exseeded the max 9/10 hrs driving in the 24hr period in question
And I have had the correct daily rest?

You cannot work more than 15 hours and have the correct daily rest. Minimum rest is 9 hours which must be completed within the 24-hour period which begins when you resume work after a daily rest period. 24 - more than 15 = less than 9, so yes it will show as an infringement regardless of the type or make of tacho.

Doesn’t matter if you have 9. 11 or 144 hours off when you finish it won’t be the correct daily rest

To add to that answer … in a 24 hour period from when the shift started 15+9=24

The legally required daily rest must be completed within the 24-hour period. What your first and last activities were is irrelevant.

If you’re having a reduced daily rest period you need to at-least nine hours rest completed with 24 hours from the start of the shift.
If you’re having a regular daily rest period you need to have at-least 11 hours rest completed within 24 hours from the start of the shift.

The only exception to this is when you’re multi-manning.

took me way too long to check this, I’ve been awake for 27 hours now due to a cough!! (On my rest days thank god)

Pretty sure you could of started day 3 45 minutes earlier that you put but it’s all still sound. Would never happen as you’d just be driving and sleeping. Even in Europe! But all seems legal to me.

You’re going to need enough breaks in the shift, or a bit of POA to keep the actual work to 60 hours for the WTD and the driving time to maximum of 56 hours over the eight shifts to be legal.

You could take 24 hours rest and resume work as long as you started another 45-hour rest before midnight Sunday. You could take 45 and resume work on Thursday without having to start another weekly rest before midnight Sunday. However, in both scenarios you could only do other work as you would not be able to do any more driving under EU rules until midnight Sunday having used the 90 hours allowed for the fortnight.

I would say no you can’t do this as you have 72hrs driving in 1 week(Max driving in any week is 56hrs, 1 week is Monday 00:00 - Sunday 23:59).
When you start your week 2, the earliest you could start would be Sunday 22:00, at the end of the week 1 you still have 2 hours left that you could drive that week.
