Thanks for the replies. So 10am 15 minute break today so I need to take my 30 minute before 4pm or 4 hours 30 driving time since my break finished at 10.15am
njl:
Plus within 9 hours of your start time, for wtd 9 hours / 30 min.
legally incorrect if the working time in the shift is over 9 hours
Is that because he’s had his 15min within the first 6hrs. And there is no 9 Hr rule ( in this case) you just get another 6 hrs to take your next break?

Less than 6 hour shift: [3 hours][15 min break][3 hours]
t.
No. No break at all is required for working 5 hrs 59 mins.
Plus all you’re examples are overly restrictive, the rules are much looser.
That’s my understanding of it.
I’m still trying to get this sorted out for my own reference. The number of threads that keep appearing in search results shows that whoever explains the basics is doing a poor job.
OK… so <= 6 hours NO break is required, and > 6 hours AND <= 9 hours a break of 30 minutes is required NO LATER than 6 hours after the start of the shift? It can be split up but it must be a MINIMUM of 15 minutes?

Just moved an = sign from the < to the > for you, and then you’re right.
I’m not so sure about removing the = from the 9 Hr?

< 6 hours NO break is required
w = 6
>= 6 hours AND < 9 hours a total break time of 30 minutes is required. First break required NO LATER than 6 hours after the start of the shift.
w = 6
b = 15
w = 2
b = 15
w = 1
total w = 9
total b = 30
>= 9 hours a total break time 45 minutes is required. First break required NO LATER than 6 hours after the start of the shift.
Example 1 is wrong.
You don’t need to take 45 minutes break before you go over 9 hours work. If you go over 9 hours work you need to take 45 minutes break before you finish your shift, and you can’t start or finish your shift on a break.
Example 2 is wrong.
You don’t need to take 30 minutes break before you go over 6 hours work. If you go over 6 hours work you need to take 30 minutes break before you finish your shift, and you can’t start or finish your shift on a break.
Example 3 is wrong.
You don’t need to take 45 minutes break after you have done 4.5 hours driving, as you could do other work or finish your shift, etc. If you have done 4.5 hours driving, you need to take 45 minutes break before you do any more driving.
