Tacho breaks and working time

please help,

my boss has tried to tell me that i have to work 8.75hrs to obtain my standard 8 hours pay because my company dont pay my 45 min (tacho) break, is this legal?

for example, i normally start at 6am, so after an 8 hour day i can go home at 2pm, but i have been told my 8 hrs ends at 2.45pm

i recall reading somewhere that as an hgv (adr) driver, my breaks had to be paid, as i have my break in the wagon, away from base.

Unless there’s something in your contract that states that breaks will be paid the company have a right to not pay for breaks.

Most drivers I know don’t get paid for breaks, it’s quite common.

if your contracted for 40 hrs and your ony reaching 38 hrs you only get paid 40hrs but you can be asked to remain at work for the 2 hours owing.

It sounds about right unfortunately. I’m paid my breaks I book from the time I get in the truck till the time I get out. Most drivers I know are stopped there breaks though its pretty common. My mrs Is a chef and she’s stopped hers too I think it’s a fairly wide spread thing tbh.

Does it state a minimum daily or weekly hours amount of pay?
What does it say about breaks?

Where you take breaks has no bearing on this issue
