Split break question

Hi Guys,

I hope you can help me with something. I am author of an app called TTGuard - Trucker Time Guard (http://itunes.apple.com/gb/app/ttguard-trucker-time-guard/id511135392?mt=8)

Currently the application in a situation when a driver takes a break after he already has had first 15 minutes of split break will not let the break be finished before at least 30 minutes of break. So the situation is like below:

-drive 2 hours
-first 15 minutes split break.
-drive 1 hour
-break 30 minutes (if user tries to start driving the app pops up message saying that he cannot finish it yet)

Now my question is if something like the situation below is valid:

-drive 2 hours
-first 15 minutes split break
-drive 1 hour (so total driving 3 hours)
-short break of 10 minutes (having a coffee at McDonalds :slight_smile:)
-drive 1 hour (total 4 hours)
-break 30 minutes (and this would be the actual second part of the split break)
-and now you can drive again continuously for 4.5 hours

So, is the scenario above possible. Is it possible to have a very short break between two parts of split (15/30) break?

Yes it is possible to have a short break between two parts of a split break, on more than one occasion I’ve put my tachograph on break with the intention of having part of a split break then unexpectedly been called onto a bay or called to a loading/unloading position before the break has reached 15/30 minutes.

Legally you can have as many breaks as you like and as short a break as you like, the only thing is that any break of less than 15 minutes will not count for the working time regulations and driving breaks will only count if they’re 45 minutes, or in the case of a split break 15 minutes then 30 minutes and in that order, a 10 minute break will still be a break but won’t count for anything

A 10 minute break won’t count as working time but it won’t count as a WTD or driving break either.


I don’t use an iPhone but I’ve just had a look at your program and noticed in the program description “reduced daily rest, which allows to drive twice for maximum 10 hours:confused:

The reduced daily rest periods and the extended daily driving limits are two completely different things that have nothing whatsoever to do with each other.

  • The daily rest periods of 11 hours may be reduced to no less than 9 hours three times between weekly rest periods (not necessarily per week)
  • The daily driving time limit of 9 hours may be increased to no more than 10 hours no more than 2 times per week (00:00 Monday to 24:00 Sunday)

Thank you for clarifying the breaks. It will help me to improve the app.

Also, thank you for pointing out the description. Just to clarify this is what the app does, it will allow to drive up to 10 hours twice per week (and it takes into account that the week is from 00:00 Monday to 24:00 Sunday with regards to that rule).

I guess the confusion was that when you drive for 10 hours then almost automatically your rest will be also reduced (at least I cannot think about a case that this would not happen?)

Sorry but I wouldn’t agree with that, I’ve gone into the 10th driving hour without having a reduced daily rest period on plenty of occasions.
