Something to think about

I’m used to the idea that the company can be sued for damages in the event of an accident, but I can’t remember the last time I saw a driver being sued for damages

It’s from Motor Transport but you need a login for that, so here’s the same story from a legal news website that needs no login

Gott o be honest and say I’m struggling to see how it was decided that the HGV driver was 75% to blame, the way I’m reading it I’d have to say 50/50 at best.

Although the article does not say how fast the vehicles were moving at the time of the accident it does say the the motorcyclist “fell onto the pavement at significant velocity”, which suggest they were not exactly crawling and yet the motorcyclist carried on even though his path was partially obstructed when the lorry move to the left.

edit: My bad, it was found that the lorry driver was 66% to blame not 75%, I’m still struggling to see it though :slightly_frowning_face:

This comment from the Judge struck me:
“Such things happen regularly without an adverse outcome. They each perpetrated a species of common or garden negligent driver error that, absent consequences such as resulted here, is not worthy of particular moral blame and, even if observed, would be unlikely to promote much if any reaction on the part of the observer.”

Thanks for posting, definately something to think about.
If his top box (or panniers) of his bike hit the camera on the truck then thats ridiculously close. As a rider myself just ease off and gtfo out of there. Regardless who is at fault there’s only ever going to be one winner between a motorbike and a truck

Darwin award winner, stupid people dying because of their stupid actions. Watch out for the appeal.
Lane filtering is dangerous at the best of times, to undertake a truck, in the left lane, suicidal.
His death must have significantly increased the average IQ of the country.

Everyone is in a permanent rush these days, it seems that hardly anyone thinks “I’ll just hang back for a minute until it’s safe…”

This is why I have to roll my eyes at campaigns seeking to achieve “zero road fatalities” Campaign all you want, you aren’t going to change the current mindset of modern society anytime soon.

^^^^ Spot on :+1:
