We got rid of two this month for the same reason, both seen by two different office bods, one was ours a recent starter, one was agency who was instantly relieved of duties and told no longer required. Our place are never on your back so it was such a stupid waste of a steady job earning good money, if they were that desperate they could have parked up for 5 minutes and had one outside the truck.
So what is the law on vaping in your cab.
I can put out more vaper than any smoker can with a ■■■, I have one that I use when on my break as I wouldn’t be able to see where I was going.
If it wasn’t for the smokers then I wouldn’t be earning easy cash on the agency.
It’s a legal requirement to display a no smoking sign in a workplace ie cab.
I’ve refused to drive 4 units this year for not conforming to the basic of legal regulations, and the agency even pay me, it’s bonkers. A 20p sticker could save these cowboys a fortune.
It’s a good job these company’s bring agency drivers like me in once in a while to point out where the regular employed workforce aren’t up to speed on current regulations.
Chuffin hell if it weren’t for me the knights of old would be sleeping on a scaffold plank across the seats.
Yet these knights of old will still stand tall and puff out their chests and remember the good ol days. Mugs

I can understand smoking in the workplace is illegal, but surely when you are on break or rest, the cab is no longer a work place. Is smoking allowed then?
So you understand smoking in a workplace is illegal,.
You just don’t understand what a workplace is?
sweepster:
Have you ever smelt your hands after using a unit that get’s passed around. Make sure you wash them before you eat as they can stink of cigarette smoke because of holding the steering wheel. I always carry wipes with me.
Ever thought that someone could have scratched their bits, poked their backside, picked their nose or not washed their hands after going to the toilet? Not to mention all manner of other filthy habits people have - it ain’t just smokers and I’d rather that (because I know what it is) than some of the other stuff that I don’t know about! Never heard of anyone getting ill or died from smelling cig smoke.

Never heard of anyone getting ill or died from smelling cig smoke.
Results Across the United Kingdom as a whole, passive smoking at work is likely to be responsible for the deaths of more than two employed people per working day (617 deaths per year), including 54 deaths in the hospitality industry each year. Each year passive smoking at home might account for another 2700 deaths in persons aged 20-64 years and 8000 deaths among people aged ≥ 65.
Conclusion Exposure at work might contribute up to one fifth of all deaths from passive smoking in the general population aged 20-64 years, and up to half of such deaths among employees of the hospitality industry. Adoption of smoke free policies in all workplaces and reductions in the general prevalence of active smoking would lead to substantial reductions in these avoidable deaths.

NO !
I’m an Ex Smoker (absolutely hate it now) I drive one wagon 99% of the time, with all my kit in, bedding, pillows, coats, spare clothes, towel, tea towel (lots of fabric).
I have to night out once or twice a week but they sometimes take my tractor for the night trunk, I hav’nt got a problem with that, except a couple of weeks ago one of the Trunkey Monkeys decided that it was a good idea to have a ■■■ in the cab, when I got in the next morning-it Reeked of his Stinking Cancer Causing Mess, when I pulled him on it, he started Bleating on about ‘Being Persecuted’
PERSECUTED ! SMERSECUTED ! BOLOX !
I’m the one who’s being put at Risk, he can stop anywhere & coat his lungs with tar if he likes, I have no choice but to drive the wagon after he’s contaminated it with his Fowl Stinking Stink.
If he does it again, I’ll be taking it further & if he looses his 30,000 pound a year job, so be it. Take your Poxy Cigarettes &
Poke 'em where the sun don’t shine.

Come on now, dont sit on the fence. Just be honest and let us know what side of the argument you fall on.
I never said its okay for people to smoke around or in the presence of others did I? I just expressed an opinion about smells! As for statistics, well they can say what you want them to say - ask any self serving body or organisation that promotes itself or ideologies that it supports.
And as an aside, I don’t ever recall an adult debate on the subject either. Just an edict from someone with an ego that imposed their will on others! I’m a non smoker if that makes a difference?!

Is that the legal answer?
Just for clarity, I am a non smoker. I used to smoke, but gave up a while ago.
I know the no smoking in the cab is part of the smoking in the workplace laws. But I was under the impression that once your duty is over, and/or you are on break, it is no longer your workplace.
And as such, I was wondering if outside the duty hours, is smoking allowed in the cab. The morals, the should you or shouldn’t you, and upsetting others is immaterial to me and not important in this instance.

I believe that once you start your daily rest if the vehicle is also your accommodation (ie: night out) then yes you are allowed to light up. I may of course be totally wrong!

It’s Passive Smoking (& the lingering smell) that’s the problem, it’s against the law whether it’s during working time or not.
I’m an ex-smoker and agree with Martin 100%
I always thought I was a considerate smoker, always had a window open, always used air freshner, always swept cab after every day so never any ash lying about.
Since quitting, I now know there is no such thing as a considerate smoker.
At our place you get sacked. It’s that simple that even the most stupid of employee can understand.
Out of interest Martin, have you tried giving your firm an invoice from a dry cleaners?

I keep my wagon tidy & obviously don’t take all the bedding out every night. It’s available for anyone to drive at night. I just expect it back in the morning in the same condition.
I would love it if they allocated smoking cabs to the smokers & non smoking cabs to the non smokers, but we all know that isn’t always practical.
Even with air freshioners, I can still taste & smell it for days afterwards, I use Neutradol Spray about 5 times a day after a smoker has been in the cab, even if he hasn’t been smoking in the cab, it’s in his clothes & fingers & that gets transferred to the seats & steering wheel.
