Yes he was halfway through the 45 hour break outside Seatruck when they knocked the door and asked to see his card asked him what break he was on he replied a 45 hour, which could be seen from his card as his last break was for 24 hours he was then taken to a hotel across the road by an officer to witness him booking in. Whenever the police speak about drivers hours they say that they are there to educate rather than criminalise drivers well here was surely a case where the driver could have had the error of his ways pointed out and put in the hotel, was a £300 fine really necessary for an offence with no threat to road safety

Thank you, I stand corrected. If this is the way things are going the ‘funding crisis’ will soon be fixed. Certainly more officers are needed as Immingham alone will keep a couple of them busy 24 hrs a day and at £300 per pop I hope they’re on commission!
With regards your point whether a fine is necessary, I agree, perhaps not at this stage. I didn’t realise this was the case in the UK, so if this is the way to go there should be a period of grace for information.

A local solicitor specialising in tachograph regs has now taken up this case, as he believes the police acted unlawfully as the UK has not stated that it is to enforce the no 45 rule apparently it is down to each country to decide it’s policy on this rule. Will be interesting to see what happens
This is absurd, a practice that has been common since the first days of long distance road transport has been outlawed overnight
What about the drivers that live in the cab full time?
I honestly believe there must be more to this story as he must have been offered the option of going somewhere else rather than a hotel because even if there is a law saying you cannot spend the weekend in your truck on a 45 off which I am not convinced of, surely forcing him into a hotel would be incarceration of some sort. Mind you we’re only truck drivers and should be treated as criminals guilty or not. If he has actually been fined £300 then it would be helpful if he could let us know which section of the Road Traffic Act he has been charged under.

This no 45 hour break rule has now come into force in the UK a driver on a 45 hour break in Liverpool was today fined £300 and escorted to a hotel to finish the remainder of his break. .
Hope his wheels were still on when he got back.

He had no option but to go into the hotel as his home is in Ireland and the police said he could not remain in the lorry for his break, not sure under what offence the fine was actually issued.
I remember some similar gobshit rule years ago when there was some stipulation about the new fangled sleeper bit in a sleeper cab had to be so many inches away from the steering wheel or something like that…I was turfed out at scratchwood because some woodentop plod decided to enforce whatever rule it was saying you couldn’t sleep in your cab…I cant remember exactly,but it was something like that.so in the middle of the night in front of him,we all just climbed back into different cabs,and told him to pee off.which he did as they couldn’t work out what to do…the relevant fact to this rabble would be…IF YOU CANT TAKE A 45 IN YOUR CAB AND YOUR PARKED UP WITH SOMEONE YOU KNOW,THEN SWAP CABS FOR THE WEKEND WHEN YOUR PARKED…check,and checkmate■■?..would that be too simple,or am I rabbling on again
