Hey, first time on here so bear with me.
Back in 2000 I had a fit/seizure/episode in my sleep. Was taken to A&E by the missus where they diagnosed Obstructive Sleep Apnoea (OSA). The seizure was thought to be caused by lack of oxygen to the brain due to OSA, but they said to report it to DVLA and see a neurologist for tests to rule out epilepsy. I completed all the tests and no epileptic signs were found. I eventually got my class 1 back on a 3 yearly renewable basis.
I had 2 or 3 more episodes over the years but they were all on rest days or holidays, so I didn’t bother reporting them to work. In October 2010 I had another episode (the first in 4 years) and reported sick to work. I was then interviewed by the company doc who said to report it to DVLA. I did this and repeated all the tests,filled all the forms out etc. My neurologist wrote to DVLA and said no signs of epilepsy were found but the tests weren’t “perfect”, as in he couldn’t say either way because I hadn’t actually had an episode while the tests were taking place. During this time I also passed my HGV medical as I turned 45. Throughout all the investigations DVLA failed to contact the specialist who treats my OSA,although I’d informed them of his details.
In September 2011 DVLA informed me that although no signs of epilepsy were found they were revoking my licence because I suffered from sleep related seizures. This ban will run for 10 years from the date of my last episode. In all that time I must be “fit free” and “free from medication”. I haven’t been diagnosed with anything or prescribed any drugs. How can they do this? I have told them I plan to appeal their decision. Any advice or tips?
