It was made quite clear in the Vosa statement that Sandy Kydd had a niche market that he had built up, sadly he also abused that Niche market to the point of his drivers running bent.
Sympathy for him? Nope, Sympathy for his drivers? Nope, they decided to run illegal and have to carry the can for breaking the law. They never gave any thought about other hauliers trying to compete in that same niche market, laying off drivers because Sandy Kydd was getting all the work.
Fair do’s running over your limits once or twice a month because of unforseen circumstances, but deliberately setting off on a journey knowing you fully intended driving beyond your hours is a no no.
Regardless what was done back in the 60’s & 70’s laws have changed, enforcement is much stricter and penalties much harsher. There’s absolutely no excuse for it nowadays so Sandy Kydd and his warriors get know sympathy from me.

So playing the devils advocate then it’s possible he could quite possibly of had every intention of getting caught. He knew what would happen, punishments etc and the fact if he did serve time inside he would be out within a couple of months etc and then could happily jet off to his villa in the sun for the rest of his life.Maybe the heart problems set in because he didn’t realise how much of an interest VOSA would take in a road side tacho check? And his plan for retirement hadn’t been put into place yet so he was getting stressed??

Buycrider, you can dress it up how you want but the hauliers of the 60’s and 70’s stuck two fingers up at the law and basically did as they pleased. That had nothing to do with the Great Depression, they were motivated by greed. If you can’t do a job legally then you shouldn’t do it at all. Loyalty to your employer is fine but it works both ways, they shouldn’t ask you to run bent and you should do them a good days work.
I’m glad the rules have been tightened, they are occasionally ridiculous but I for one don’t want to be working 20hrs/day. My family have been in transport for years as drivers and I’ve heard plenty of tales of 3 logbooks etc. All my family agree, it had to change. It put too much pressure on the drivers and the increasing traffic levels were always going to end in disaster. Time to move on & kick out the cowboys.

there is a big diference in this day and age between minor offences and deliberatly flouting the laws. wake up and welcome to 2009. This is not a case of making a mistake, miscounting hours, or forgetting to put a chart in, read the judgement , read the drivers own words, they deliberatly set out to to break the law, in full knowledge of what they were doing.
I was no angel when I was driving, and yes I bent a few laws on occassion, anyone who has driven for any length of time on long distance will have, But I never set out on a day intending to do it. circumstances of that day led to the transgressions, in this case these guys set out first thing in the morning knowing that they were going to take liberties.
Sympathy… I have none, I have sympathy for the guys who worked legally and got laid off as thier boss couldnt compete, I have sympathy for the bosses who worked their asses off to try to run a business legally when their compitor was rigging the the field.
Like the laws or not, you cant pick and choose which laws to deliberatly flout, these guys did thought they could get away with it, and paid the price, dont want to do the time, dont do the crime.
I have worked with VOSA on a company that was non-compliant with the law, That company despite extracting the urine on hours, once pulled by VOSA buckled down and implemented VOSA’s suggestions, took their advice and worked with them to bring the company in line with the law… they never got in front of the TC, VOSA worked with them to resolve the problems. the worst thing you can do when caught out is shut VOSA out… which is exactly what happened in this case,
there is only a few people to blame for this situation and every single one of them work for Sandy Kydd

You put up a very childish argument. I think that TC’s would probably look upon someone who was 2 mins short on a 45 mins break more favourably than someone who regularly had between 6000 and 10000 kms missing mileage.
It’s all relative. Those who take such a blatant disregard to the rules deserve everything they get when they are finally caught.

Nobody on this thread has claimed to be whiter than white, everybody goes a few minutes over their 4.5h from time to time to get home on a night or whatever. There’s a big difference between that and running up to 4 hours a day, day in day out, without the fuse in.

He could also be lodging an appeal
Revocation of the licence takes place on the 17th, the delay is supposed to give the O/Licence holder time to lodge an appeal, can’t see that happening in this case though.
how does it count with the vosa if you head east of poland and the important issue is a safe parking and not the hours that you do? Just asking as many a time never found a parking in my driving hours and just chapped on till got somewhere safe and im not talking just over my hours im talking maybe 3hrs or more! I understand the case against mr kydd and this is slightly off topic but would like opinions plse
