Well beaver me old chum, I quite agree with you 100%, I am a people person and always have been, I believe in doing someone a good turn rather than a bad one but everyone is different. However I have found some people on this forum do not reflect who I work with, but then the only ones I do get on with are normal working blokes, donā€™t let the plebs get you down buddy. Iā€™ve seen people have pot noodles while driving. Iā€™ve also seen people drinking a coffee while smoking a cigarette.
I donā€™t see how holding a mobile phone to your head is more dangerous yet the above two are totally legal.

It is a fair point adam, we have all done it but this guy unfortunately held his phone to his ear in which case the poor sod got caught. If I was to speak on my phone whilst driving I would have been inclined to have put it on loudspeaker and held it at my knees. It is a shame he got sacked as nobody wants to see that happen to anyone. You just donā€™t know who is watching you nowadays. I vape in my cab and have seen people looking at me. Why anyone would go out of their way to get someone sacked is beyond me but I do believe in Karma.

To say drinking etc is totally legal is not quite correct, whilst there are no laws against them apart from the smoking in the workplace which a truck is a workplace so that makes it illegal, you can be prosecuted for anything like that you do while driving, for not being in control of the vehicle.

Totally agree mate. An LGV driver with their phone to the ear is a good visual representation of the typically ā€™ thick ā€™ lorry driver of today. It is without doubt unacceptable.

What ā– ā– ā– ā– ā– ā–  me off though is the culture of Doris and Bob in their Volvo 740 estate full of discounted plants from the local garden centre policing the roads. Then we have the spineless large corporate logistics crew covering their arse and protecting shareholders share prices and no doubt grovelling to Bob and Doris and apologising.

Why didnā€™t this driver get a final written warning? That would be enough of a mind concentrating shove :neutral_face:
And if this employer is so desperately concerned, surely they would forward the footage to the police? @robroyā€¦your comment about how much of a distraction is it really ? I know what you mean to a point. Any call is a distraction of sorts and in years gone by holding the phone to your ear as opposed to hands free is technical when the actual distraction is the call itself, however my view is that these days with smartphones itā€™s much more of a distraction. How many times do you pass someone in lane one with a phone in their hand but scrolling and not on a call?
The only way to deal with it is a blanket ban in my view. With modern technology there should be no reason whatsoever to have a phone in your hand, the only reason these days is if you are not on a call but facebooking etc, hence the increase in punishment and rightly so.
Iā€™ll say it again, but I would grass anybody using a mobile while driving these days as I doubt they are actually on a call but doing something that requires more attention.
A friend of mine works for Wincanton and he told me about a driver who had a car clip his near side from lane 1, wedge across his front and then run down his off side because she kept her foot down in a panic. She was young and owned up that she was texting when she drifted. The worst thing is that she was texting a contact number to her best friendā€¦who was sat in the passenger seat ffs!!!

Couple at our place have been suspended since August Bank Holiday weekend when caught in a police crackdown, presumably due to the police not supplying the evidence to the firm as yet, if they have it at all.

What makes me laugh us when people have them on loud speaker but then hold it up near their mouth, ffs they really are stupid, they may aswell.hold it to their heads.

Any wired headphone kit for a phone is illegal to use for two reasons.

One itā€™s in contact with the phone therefore not making it hands free.

Two wearing two earphones is illegal and it makes it harder to hear outside noises.

Both could get you a ticket.

Had this come up the other day at my new jobs induction, it surprised me I must say. Apparently itā€™s not illegal to wear or even talk on a bluetooth earpiece/headset but the second you reach up to press the accept/end or volume controls on it you are then classed as operating a handheld device :open_mouth:

Also for all you vapers out there, the Police are apparently looking into whether to class the vape machines as a handheld device as itā€™s electronic and would therefore have it fall under the same category as phones and therefore illegal to use whilst driving too, so if you vape Iā€™d advise you look into that and keep an eye on it becoming a thing.

I think in 20 years time if the robots havenā€™t taken over yet then this job will be a complete nightmare of red tape and 24/7 surveillance. I best start looking for another skill set. :grimacing:

Considering heā€™s agency, being ā€œsackedā€ wonā€™t make a jot of difference to him. Heā€™ll simply work somewhere else on Monday. As for reporting him, he wants to count himself lucky that footage was only sent to his employer. If it had found itā€™s way to the police, the consequences would have been much more serious.
We all know the rules, if youā€™re stupid enough to break them, you canā€™t complain when youā€™re caught.

I find it fascinating how successful the enforcement agencies have been at getting people to put using a phone while driving into the same outrage bracket as drink driving. Itā€™s been a very successful campaign.

Far too strong sacking the guy on the spot. There should at least be a warning given before notice. Yes the guy was an idiot using the phone but no puppies killed or kittens squashed. If the guy had driven onto the pavement and taken out a load of geriatrics waiting for the day centre bus itā€™d be a different story. Its bad enough drivers dobbing each other, a real shame some folk cant just get on with their own lives instead of constantly sticking their nose in othersā€¦

Hands-free phone law

The police still have the power to stop you if they believe you have been distracted by using a mobile phone while driving, even if itā€™s fully hands-free. Some road safety groups believe mobile phones should be completely switched off while driving, to avoid any distractions.
