Running over the 4.5 driving limit accidently

I unintentionally for the 1st time in my driving career have exceeded the 4.5 driving limit I completely missed the 4.15 warning symbol on the digital tacho (my usual vehicle gives me audible clicks to warn me and the dashboard warning symbol comes on) however the vehicle I used today for the 1st time an old junker never gave me any early warning signs, hence me running over.

Can someone give me some information on the implications for me having done this, and how long long this infringement will remain on the digicard memory.

Your tacho analysys/employer will probably need you to sign that you did it and are aware of it so a tiny black mark on your works record at worst

Do you know how long will the infringement remains on the digicard memory and can/will Vosa etc pull me for it if they stop check me?

It will probably remain on it for 9+ months but VOSA usually only take any action within 6 months BUT in your case they WILL NOT BE INTERESTED as a one off if you have explained your error

VOSA know that human errors often happen

It probably depends on how far over the4.5 hours you were, if it was just a few minutes you would hopefully get nothing more than a verbal warning at a spot check.
If you’re talking about more than about 15 minutes you could be looking at a fine.

Do a printout and write a plausible explanation on it, unexpected traffic congestion or something like that and as long as you’re only talking about a few minutes over the 4.5 hours you should be OK.

Either way you will get an infringement off your company, but that’s nothing to worry about :wink:

23 minutes over mate, my only genuine explanation would be that I simply didn’t hear or see the time nearly up warnings, I’m not sure if this would pass as a plausible explanation. The company are Ok about it, I was just concerned that I might be fair game for Vosa or Police should they stop check me and what the repercussions could be, I always run legit which I guess will show on my card.

23 minutes is pushing it a little bit, but you do have a clean card so I would have thought that unless you have the misfortune to get checked by a [zb] of a VOSA bod you should be al-right.

All the VOSA people I’ve met have been OK, but there’s always going to be the odd one who’s a [zb], so lets hope you don’t meat him :grimacing:

The possible fine is £100, but it would be a very harsh VOSA bod who didn’t let you off with a smacked wrist, I wouldn’t worry about it :wink:

I’ve been stopped for 5hours continuous driving and only having 20 odd minutes after a 4.5 hour stint, both within 28 days. I got a little telling off and that was it. I was honest and told them it was for personal gain lol. Don’t worry about it you’ll be fine. Just don’t to it to often.
Btw I also gave my statement in the cab, but you get the option of going to a police station.

For the reply and the reassurance, I’ve never run over before in 14+ years of HGV driving, so its a grey area for me and you hear all the horror stories (urban myths) about massive infringements fines etc (banded around by other drivers). :wink:
