Rest rules (1 Day=24 hours)

Hi guys,

My question is when do I start counting each day, I mean from what time to what time.
Every day we are allowed to drive 9 hours (10 hours twice a week) , then have rest 11 hours (9 hours twice a week), but this day, when does it start and when does it finish■■? I m a bit confused.

The rules never use the word DAY for this reason - they use 24 hour periods

A new 24 hour period starts at the end of any rest period even if the previous 24 hours period has not ended

Example
Daily or weekly rest ends at 0600 = the 24 hour period starts
Daily rest starts at 1900
The above rest period ends at 0400 = a new 24 hour period starts and stops the previous 24 hour period at 22 hours

Think of each “day” as a 24 hour block. Lets say you start at 6am, you need to be done and card pulled before 7pm to get the minimum 11 hours rest in or you can go to 9pm which will count as a reduced rest because you’ll only get 9 hours.

In any 24 hour period from when you start your shift you need to have either a minimum of 11 hours off or a minimum of 9.

You can reduce to 9 hrs rest 3 times a week not 2.As well…

The daily driving time is the driving time recorded between 2 daily rest periods or between a weekly rest period and a daily rest period, it doesn’t matter if the shift starts one day and ends the next day.


The daily driving time should not exceed 9 hours but this can be extended to 10 hours twice a week.

When extending the daily driving time on Sunday night the regulations don’t give precise information about which week an extended daily driving period should be counted for, however the regulations say that “the daily driving time may be extended to at most 10 hours not more than twice during the week”.

Because of the wording of the regulations, when extending the daily driving time my opinion is that:

  • If the extension begins before midnight on Sunday it would count as an extended driving shift for that week.
  • If the extension begins after midnight on Sunday it would count as an extended driving shift for the following week.

(The extension begins when your driving time goes over 9 hours)

You can have reduced daily rest periods 3 time between weekly rest periods not twice a week.

The ‘week’ is a fixed period of time that has a beginning and an end.

The rules for the allowed reduction of daily rest say “between weekly rest periods,” NOT per week.

This allows that a driver can take a weekly rest any time in the week, which re-sets the allowance for reduced daily rests, therefore it’s legally possible to take more than 3 reduced daily rests per week.

It might help to think about it like this…
All your driving, other work (crossed hammers) POA and breaks have to “fit” into a 24 hour period.
so…
You must have a minimum 9 hour, reduced, daily rest in that 24 hours (but only 3 of these between two weekly rests) therefore you can do 15 duty hours before taking the reduced 9 hour rest.
15 + 9 = 24

The next 24 hour period then starts. (up to a total of 6 before a weekly rest)

Once you have had the 3 x 9 hour reduced rests you must take 11 hour, normal, daily rests.
To get the 11 hour rest your duty must not exceed 13 hours.
13 + 11 = 24

The next 24 hours starts at the end of the daily rest - however long that was.

A common thing that drivers get wrong is this…
you start at 0400
your duty ends at 1900 (7 pm) = 15 hours
you start work again at 0700
how much daily rest have you had■■?

The answer is… A reduced 9. ( Not 12 or 11)

One of the golden hours rules is;-
13 hours +11hours = 24 hours
15 hours + 9 hours = 24 hours
13 hours and 1 minute = 15 (because you cannot get a full, normal, 11 hours rest so therefore it is one of your reduced 9’s.)

All you have to remember is that there are only 2 sorts of daily rest.
A reduced 9 hour daily rest and a normal 11daily rest.
If you can’t fit an 11 hours rest into the 24 hours from the start of your shift then you must have had a 9 reduced. …regardless of the time you start your next shift.

Easy once you get your head around it, this is the rule that is misunderstood by even experienced drivers.

Maybe it’s the way that I’m reading what you’ve written, but are you saying that if a driver can’t fit a normal daily rest into the 24hr period that commenced at the start of his shift, the resulting reduced daily rest is to be counted as a 9hr reduced rest regardless of whether it might have actually been 10hrs or 9.5hrs?

I’m thinking that the 9hrs might better be thought of as the minimum requirement for a reduced daily rest, but clarifying that anything less than 11hrs is acceptable and counts as the actual number of hours taken, provided that it isn’t less than 9hrs.
