Recovery trucks

Yesterday I had the joy to breakdown in my car 140miles from home. Got recovered by a 10 tonne ex AA recovery truck by Green Flag. Talking to driver he said they are driving without tacho as it’s classed as out of scope. Is that correct and if it is why would they get away with it.

He’s right they are exempt up to a 100 k radius from base .

Question is why? He says they run him ragged and rarely gets a break. How can that be right

No, it’s a long story of a complete Fark up by Green flag. Burst a brake pipe at 16.23 finally got home at 02.15 not amused.

There’s an exemption from the EU regs for recovery vehicles operating within 100km radius from base.

This then means they come under GB domestic regs, if they drive for less than 4 hours a day and stay within 50km of base, then no records are required at all for that day. If that doesn’t apply then legally they need to make records, either a logbook or use their Digi card and set it to out of scope.

When operating under GB domestic, you can drive for 10 hours in a 24 hour period, straight, no breaks required

You can work for 11 hours in a 24 hour period (other work + driving) no limit on shift length, no daily or weekly rest requirements, so you can work 7 days a week.

But for emergencies the limits can be ignored

Wtd breaks don’t apply and unlike when under EU regs, you can opt out of the 48 hour average weekly hours

It’s because you can’t have accident damaged or broken down vehicles left blocking carriageways because all the drivers at recovery firms covering that patch are out of hours or even delayed getting to the scene whilst they finish a 45.

Of course, you can still be sat there hours whilst they finish another job but that’s the general school of thought.

Here’s an example of a lot of deaths where it’s possible the recovery driver was over-tired although I believe the lorry they hit did cut them up without indicating.

Like driver training vehicles they only pay £165 VED supposedly because they are not revenue earning vehicles. This rate hasn’t increased in over 16 years.

They are classed as a private training vehicle …no different to a learner car… they both earn revenue but are not for hire and reward per sa. They are being paid to teach a person to obtain said qualification a complete difference.

Could have had the same problem with the AA,my Daughter broke down in Newquay picked up at 09.30 got home around 19.30 after Newquay to Exeter change vehicles Exeter to Bristol change again Bristol to Gloucester change again Gloucester then home to Atherstone.
That was after I had been down to Newquay to bring her dog home because the AA could not guarentee that their Drivers would accept having a dog in the vehicle.

This is why the AA call their recovery service “Relay”. I know that Britannia Rescue will take you all the way on the vehicle that first picks you up, not sure which others will do that.

They might, but the subbies providing Britannia cover will be the same ones doing Mondial, call assist, aa, rac etc so don’t take it for granted. As a general rule of thumb the quieter it has been that day the more likely your controller will let you travel out of area to the final destination. But once you need to venture out of the 100k zone you are on tacho for the rest of the day. Small cars can go onto a 3.5 tonner to avoid that of course.

As an aside one of ours got a fine for not having tacho in before he’d left the zone as you are meant to go over as soon as you know you need to leave it.

might be diffrent now but some of the recovery vehicles were exempt from testing and also had cheap tax. these were the ones with a spec lift . long as you only lifted 2 wheels you were in the exemption class

Full tax on 10 tonner is only 200 anyway. Tow a trailer as well for free :smiley:
