Is it legal to tell you that if you don’t get any/ more poa in then you will be having time off unpaid ,now I’ve no issue putting in poa / break if it is possible but on shop deliveries I can’t see how it’s possible,I did 4 drops today,14 hrs and 1 1/2 hrs break,no poa,now I’m being told it’s the company policy that you must put in poa every day,if you don’t then you will be having time off unpaid
I brought the fact up a while ago I was going way over the 48 hr WTD rule and could I have some different work,short runs etc to bring my hours downbut it just fell on deaf ears,till now where it’s come to a head.
Shouldn’t it be there job to plan the drivers hours taking into account WTD,not just say if you don’t put poa in you’ll be having time off unpaid.

I’m unsure of the point you’re making exactly. Yes its their job to manage your hours taking into account the 48 hr WTD rule. Yes they don’t have to pay you if you’re not working. Its probably a complex issue taking into account you contracted terms of employment. If your hours are racking up then you’re going to be off, if you can see where exactly thats headed you might be able to have a day off or so a week just before the end of your period to comply with the WTD hours and you’ll still be in weekly pay, rather than sitting it out until things come to a head as in Ross V Stobart ? You’re not spelling out your stance on it really, do you want to comply? do you want max hours, do you want time off, are you willing to have a day off to bring the hours down? What i mean is if you want short runs and cant get them, rather than asking to do 6 hours on thursday and say six hours on friday, why not do twelve on thrusaday and have Friday off ? Is that an option?
You cannot legally book POA or break if actually driving or working so if your sort of job does not allow that then there is nowt you can legally do about it
Are you and the company aware that the authorities have virtually no interest in the RTD(WTD) - there are no sanction for breaches listed in the VOSA sanctions list
Before the RTD started in 2004 we managed fine for decades so perhaps your current job is not for you?

This! No one on earth gives a flying fox about WTD RTD unless something goes wrong, then MAYBE and it’s a big maybe they might.
