Just need some guidance about how or if POA affects what breaks need to be taken.
Example1: If i work 5 hours then have POA of 30 mins do i have to take a break after another 30 mins to comply with WTD? So what i am really saying is can POA take place of break or can it delay when you take a break , eg If I work 5 hours , take 30 mins POA , can I work another 1 hour before taking a 30 min break.
Example 2: If i drive for 4hours then have 1hour POA the driving time is wiped clean on the digi tacho. Does this mean I dont need to take a break after 4.5hrs driving?
Different people I have asked have given me different answers so there is obviously confusion out there!
As I understand it using POA doesn’t take place of u’re break, if u use POA u musnt be doing any other work it’s there for known periods of delay or waiting. If u do 1 hour POA after 5 hours work then u still have 1 hour before u have to take u’re working time break. Hope this helps.

Take 15 minutes break here.

You have to take a break at 4.5 hours driving, in this case you haven’t had a break.
Remember the Hobbs mantra, if it qualifies for POA, it also qualifies for break, so take a break if it doesn’t affect your wages instead

You need a break of at least 15 minutes after 6 hours work (driving and other work). POA does not count as work so you would not require your break until completing another 1 hour work in the situation when you have 30 minutes POA after 5 hours…

No, you must take a break of at least 45 minutes at 4.5 hours in that situation. Under normal operation POA is not break even though the digi tacho incorrectly regards it as such.
