Our reps have asked for a pay rise of 5%
The company amongst other things have come back with
Would you consider reviewing pay in any of the following ways
Reviewing working terms
Only guarantee 45 hrs( currently 50)
Removing dark hours payments
Being paid by the minute
Restrictions on holiday bookings ( seasonal)
A few questions
To change your contract from 50 hrs guaranteed to 45 hrs they’d I guess have too give you notice of change of t and c ,s, how long
Removing dark( night shift) payment from your wage,is it legal too do so ,can they pay you day shift rate 24 a day
Payed by the minute ,can’t get a answer as too what they mean by that,so any one on such a contract, how does it work,I doubt you benefit, but if so how
Restrictions on holiday booking ( seasonal) ,we have one at Xmas time but again not sure what they mean any ideas

From the sound of it any change of contract would be agreed with your union as part of a pay deal, so any notice of change of contract would be agreed with the union at the same time as the pay deal.
Removing night payment would also be part of the pay deal so again would be agreed with your union.
To be honest I wouldn’t worry about it, the company are just testing the water to see what they can and can’t get away with and your union will be aware of that and negotiate accordingly.

Usually 90 days unless both parties are happy to do it sooner.

Yes of course it’s legal and yes they can.

Either taking it in turns to have Xmas off or only allowing so many off at busy times i’m guessing.
Thanks both of you,but I’m still intrigued too know what they mean by PAID BY THE MINUTE,anyone

Possibly zero hours contract.
It won’t be literally paid by the minute because it would create havoc for the wages office

Or it could mean if you finished at let’s say 16.05 pm then before they might pay you until 16.15 but with a paid by the minute contract maybe you’ll only be paid till 16.05, think of what that could save over a year .

You get paid by what you work so yes they could do it to the min if wanted after all its only the hourly rate divided by 60 aint it …
I would think that as said it’ll be rounded up to the nearest 15 min.
This seems like a classic response to the workforce asking for a pay rise.
The Company start to look at your current terms and conditions and instead of finding ways to improve your pay they start trying to change the way you are paid, by changing hours, start times, days that you work, paying by the min!! and so on.
So for no actual increase in pay they tinker around a bit with your conditions and tell you that your hourly rate has improved.
It is their opening position and negotiations need to move the process along.
Good luck
