Out of Hours

Can anyone tell me the law on a company wanting to bring in the day driver(doesn’t have night out kit with him) when he has reached the end of his 15 hour working day.Can you be collected by two drivers,one to drive your vehicle back,and one to drive you back in the company car?Is this legal,and what is the procedure for being paid for the extra hours at work over the 15? :open_mouth:

Illegal to get a lift back as basically that’s still work but in reality you’re not likely to get caught. As for being paid extra for going over the 15 only your boss can answer that one .

EU regs 561/2006 article 9

  1. Any time spent travelling to a location to take charge of a
    vehicle falling within the scope of this Regulation, or to return
    from that location, when the vehicle is neither at the driver’s
    home nor at the employer’s operational centre where the
    driver is normally based, shall not be counted as a rest or
    break unless the driver is on a ferry or train and has access to a
    bunk or couchette.

Without being prepared for nights out all the driver can do is to make for the nearest motel etc, take the required rest period and then restart
If the boss wants the truck back then thats not a problem because another driver can come down in a car/van and leave that for the finishing driver to use after taking the rest period
After the rest period the driver can use that vehicle (other work if a car) to return to base
