If I was on my 6th and last shift for the week and had
the misfortune not to make it back to the depot within my hours
what would be the consequences :-
Would I have to stay out and have a day away for my rest day ?
Could the company pick me up ?
I am sure there must be a simple solution I have overlooked
Regards
Mark

Weekly rest in the cab if no duty time remaining
Can be picked up if duty time remaining and another person drive you back to yard/home.
(In real life - I’d be getting picked up no matter what or turning back to the yard with enough time to get back)
The consequences are the same as any other day, if you run out of driving time you can legally be picked up and taken back to base as long as you can get back before running out of working time, if not you need to park up until you can legally start work again.
In the real world you’re probably going to make sure you get home one way or another regardless of what the regulations say
Or run a seventh card, as long as you get back before your start time at the beginning of the week.

Basically you need to start your weekly rest 144 hrs after starting your working week.
The Sarge:
Or run a seventh card, as long as you get back before your start time at the beginning of the week.
How does that work with a digicard
Depending on when you finished your last weekly rest you may be able to have a night out and run in the following morning.
If you are already at the end of your 144 hours then in theory, as has been said, you are staying out for your weekly rest.
However - let’s be realistic. Get a lift back so you aren’t actually driving and are being chauffeured, make sure you record it as work or POA (but not rest or break) with your reasons (going home through choice) and keep that record with you for 28 days etc. If anyone in authority queries it - so what? They are not going to fine you (they can’t). They aren’t going to push it through court - that isn’t in the public interest. Just do what you feel you need to do but record it. Then make sure you take the full amount of rest as required.
The problem comes about when people fail to record the hours - that becomes falsification of records which is worthy of a trip to court.
