My company has just taken delivery of some 100 tractor units.
they were taxed from the 1st nov 2011 the tax expires 31/ 10 /2012
the plate date is 7th nov 2011
i believe the company took possession of the units from the dealer a few days at the most after the 7th nov
I am aware that the firm has 28 days to obtain and display the operators licence in the wind screen
As of the 9th dec 2011 they had not obtained these disks and were asking the drivers to use the units on the public highway
they informed the drivers that they had requested these licences but a telephone call to the VOSA help desk confirmed the unit i was asked to use was not on the VOSA data base
so
do,s the 28 days start on the 1st Nov 2011
or when the company took possession of the units ■■
i declined to take the unit on the road on the 9th dec
am i correct the company are breaking the law??

Not your problem, there are no sanctions for the driver if the disc isn’t displayed so you might as well drive it anyway. Unless it’s a Scania of course then you did right to refuse.
The company has one month to apply for the discs, ie notify VOSA that they are operating the vehicles.
This period starts when the vehicle is first operated, not when it is bought or hired.

and started to operate them straight away, then “a few days at the most” after the 7th December is when the company needs to notify VOSA.
I make today the 10th December, well within “a few days at the most” after the 7th December.
You don’t say whether they are replacements or if the company is brand new?
Depending on how the vehicles are notified, there can be quite a delay before they are issued discs or entered on the database.
Armed with the information you have given, I expect I would have taken it out and strictly
speaking it is none of the driver’s business.

They can be slow in sending out the discs but as Coffeeholic said, it is not a driver’s problem in any way shape or form. They cannot fine you, ban you or do anything at all to you. Nothing, niemo, nichts, nada.
I would just add that if they have just taken delivery of a hundred tractor units, they are unlikely to be some type of Mickey Mouse outfit.
